M., last boat leaves 4 4 The Secretary shall keep a record of all reporta by names and residences of all eases of contagions diseases that may be, from time to time, reported to him by the attending phvsician, Health Officer or any member or the Board, or that may otherwise come to his know ledge. He shall also keep an accurate record of the proceedings of the Board, and shall enter upon such record all orders made by the Board and all re ports made by the individual members thereof, or by the Health Officer, and shall niaTce 'such reports to the State Board of Health as the existing laws may require, and perform such other duties as may be imposed by Statute or by the Board of Health. ARTICLE II.— H e a l t h O f f i c e r . S e c t i o n 1. It shall be the duty of the Health Officer on or before the first day of each and every month, to be at the office of the Secretary of the Board of Health, to receive, examine and se cure the registration by the Secretary, of all certificates and records of death and causes of death, and findings on in quest. He shall execute all orders issu ed by the Board directing him to take necessary steps for the abatement of any nuisance, found existing within the jurisdiction of the said Board. He shall visit any person or persons reported to be sick w ith cholera, diphtheria, small pox, varioloid, scarlet fever, yellow fever, or any infections or contagious disease, and shall cause all persons who may be infected with any infectious or contagions diseases, if cousisteut with public safety, to be strictly and efficiently quarantined upon the premises where the same may first be discovered; and he shall also prohibit any person from leaving or entering such premises, while the necessity for such quarantine exists, without his con sent. The Health Officer may also cause such removal when directed by the Board of Health, or auy member thereof, aud in all other cases that shall come to his knowledge, where lie may consider such action necessary to the preservation of the public health. Ordinances, Rules and Regulations 1907 In pursuance of Chapter 661, Laws of 1893, and of existing laws relating to public health in towns not wholly or In part repealed thereby, aud in pursuance of the laws ameadatory thereof aud supplementary thereto, be it R e s o l v e d , Bv the Board of Health of the Town of Hempstead, at a stated meeting held iu the Town Hall in said town on the 3rd day of July, 1906, (all the members of the said board having been duly notified of the time and place of holding said meeting) that the following Ordinances, Rules and Regu lations relating to the Public Health iu the said town lie and the same are here by adopted: ARTICLE I.— M e e t i n g s . S ection 1. The meetings of the Board of Health of the Town of Hempstead shall be held at the Town Hall in said town, on the first hud third Wednesdays in the month of May, June, July, Aug ust, September and October, aud on the first Wednesday in the months of Jan uary, February, March, April, Novem ber and December at 1.80 o'clock, P. M. * 2. Special meetings shall be held at such time and place as may be designat ed by the President of the Board, or by any three members thereof. ARTICLE I I I .— P h y s i c i a n s , M id w i v k s a n d D r u g g i s t s S e c t i o n 1. It shall be the duty of the physician or midwife in attendance at every birth to write out aud sign upon the form prescribed by the State Board of Health, the certificate of such birth, and transm it said certificate to the lo cal Board of Health, or the person desig nated to receive it, within thirty days of such birth. It shall be the duty of the physician or midwife in attendance at every stil birth to w rite out aud sign upon the form prescribed by the State Depart ment of Health the certificate of such still birth, and transm it said nertifincte to the local Board of Health, or the per son designated to receive it, within thir ty days of such still birth. The physician or midwife, attending at the birth of a child shall at the time of filing such certificate of birth, unless it contains tin- given name of such child, cause to be furnished to the parent or custodian o f such child, a name card. which shall be filled in by such parent or custodian, w ith the given name of such child when named, and immediate ly filed w ith the Registrar of this Board. Blank name cards will be furnished to physicians aud midwives by the Regis trar Auy violation of the provisions of this Ordinance, shall subject the offend ing party to a penalty of Ten Dollars. ) 2. Every householder or head of the family iu a house wherein any case of infectious disease may occur shall report the same to the Board of Health within twelve hours from the time of his or her first knowledge of the nature of such d isea s e , and until instructions are re ceived from the said Board, or the Health Officer, shall not permit any o'othiug or other article whicn may have been exposed lo the infection to be re moved from the house; nor shall any occupant change his or her residence elsewhere without the consent of said Board, or Health Officer. Every physician who is called to at tend • case of infectious or contagious disease, shall as soon as be discovers the nature thereof, make a written report, specifying the name and residence of the patient, the nature of the disease, and any other facts relating thereto which he may deem important to the public health, .and sign his name thereto, and he shall transmit the same to the Board of Health within twelve hours from the time of hie or her first knowledge of the nature of such disease. Any physician practicing as aforesaid, may be requested, upon no tice from any member of this Board, to visit any urgent case of infections or contagious disease or sickness within said town, and report to the person so requesting him immediately thereafter. Aud for such visit aud report he shall be entitled to receive the sum of three dol lars, to be audited aud paid i n jthe same manner as other town charges. $ 5. No physician, druggist or othei I persou shall make, sell, put up, prepare j or administer any prescription, decoc-1 tion or medicine, under any deceptive or j fraudulent name, direction or pretense; | nor shall any false or deceptive repre- ' sentation be made by any person to any other as to the kind, quality, purpose or effect of any such, or other drug, medi cine, decoction, drink, or other article offered or intended to be taken as food or medicine. § 6. No poisonous medicine, decoc tion or substance shall be held for sale or sold except for lawful purposes and with proper motives aud by persons compe tent to give the proper directions and precautions as to the use thereof; nor shall any bottle, box, parcel or recep- ticle thereof be delivered to any person unless the same is marked “ Poison,” nor to any person who the p a rty deliver ing the same has reason to think intends it for auy illegal or improper use or pur pose. 9 7. No person shall make, offer oi have for sale or keep at any place of sale any “ poisonous, unwholesome, deleter ious or adulterated drug, medicines oi food” or iu respect thereto omit auy act or thing required or do any act forbid den by any law or health regulations of this State applicable iu any part of said ARTICLE IV — C l e r g y m e n S e c t i o n 1. Every clergyman or magistrate who shall perform the cere mony of marriage within this town, shall, w ithin thirty days thereafter, file w ith the Secretary of the Board of Health or Town Clerk of the Town of Hempstead, the certificate of such m ar riage. And for every certificate so filed as aforesaid, he shall be entitled to re ceive the sum of twenty-five cents, to be audited and paid in the same m anner as other town charges. And for any ne glect ov refusal he shall incur a penalty of twenty-five dollars. ARTICLE V.— C o n t a g i o u s D is e a s e s S e c t i o n 1 No person or article li able to propagate a dangerous or contag ious disease shall come or be brought w ithin the limits of this town without special permission of the Health Officer; aud whenever it shall come tc the knowledge of any person that such infected person or article has come oi been brought within such limits, he shall immediately notify the Health Of ficer, or Secretary of the Board, or some member thereof. § 2. No persou shall carry or remove from one house or building to another, or from any vessel to the shore, or from the shore to auy vessel, within this town auy persou sick of any contagious dis ease without first having obtained a per m it therefor from the Health Officer. 9 3. No persou by auy exposure 01 any individual sick of any contagious disease or of auy dead body supposed tc be infected with any contagious disease, or by any negligent act connected there with, or in respect to the care or custody thereof, or by a needless exposure of himself, shall cause, contribute to, 01 promote the spread of such disease from any such person or any dead body. f) 4 There shall not be any public or church funeral of any person whe shall have died of any infectious or con tagiuus disease without the permit of tin- Board of Health therefor. (1 5. It shall be the duty of each householder or head of the family iu a house wherein any case of infections or contagions disease may occur, to disin fect and fumigate the said house, or any portion of the same, that he may he di rected to do by the Health Officer of the Town, in such manner as the said Health Officer may direct. 9 6. Any person or persons who shall willfully violate any provision <>f either section of this article is guilty of a misdemeanor, and in addition thereto is liable to a penalty of fifty dollars for each and every violation thereof. ARTICLE VI.— B urial P ermits . S ection 1. On the decease of any person within this town, it shall be the duty of any Justice of the Peace or the Town Clerk of said town, to issue to the person or persons having charge of the remains of the deceased person, a burial perm it; such permit to be issued upon a physician’s certificate upon the form prescribed by the State Department of Health, of the cause ot rteatn, or upon an inquisition: or in case no such certi ficate can be had. and no inquest shall have been held, then such permit may be granted upon affidavit or affidavits duly verified before a Justice of the Peace, who shall be a member of the Board of Health of the town, or by some person or persons known to the officer granting such permit setting forth the etroumataneee, time, aud cause of death, as nearly as the same can be ascertained. Aud the remains of no deceased person shall be interred within the town, or re moved for burial outside the limits there of, except upon a permit first had and obtained in the manner hereinbefore provided, and for issuing such permits, said Justices of the Peace aud Town Clerk shall be entitled to and receive 25 cents for each and every permit so is sued. 4 3. Any person who shall inter or cause to be interred, or who shall re move from this town for burial outside the limits thereof, the remains of any deceased person without a burial permit duly issued in accordance w ith the above provisions, is guilty of a misde meanor, a n a is in addition thereto liable to a penalty of twenty-five dollare. ARTICLE V II— D is e a s e d a n d D is a b l e d A n im a l s . S e c t i o n 1. No diseased or disabled animals shall be brought or conveyed in to this tow n : and no diseased or disabled animals shall be left exposed upon any highway, street, avenue or any premises therein. No persou or persons, corpora tion or corporations shall conduct a slaughter house, or any fat boiling or rendering establishment or manure dump or any establishment for manufac turing fertilizers in said town without first obtaining permission of the Health Officer and a majority of the members of the Board of Health of said town. 4. Any person who shall refuse to allow an inspection by a member of the Board of Health, the Health Officer, or physician, or officer duly authorized, to be made of and concerning any alleged nuisance on bis premises, or who shall hinder or obstruct or interfere with any such member, physician or officer, in the making of such examination, is guil ty of a misdemeanor. t) 5.
