Terry: of T-errr- ville , an employee of the de- partment , to whom the prop- erty was transferred by High- way Superintendent Harold _£\ Davis , and from a pit owned by William L. , Underwood of Patchogue , who has appeared on several occasions ias Mr* . Davis ' attorney. Concrete blocks have been bought by the town from a concern in whieh the same Terry, and Mrs, Alice Fer- rer of Celnter Moriches , wife of Deputy Highway Superintendent Ru=s_ - sell Ferrer , are members. The \Terry sandpit\ is located on the Davis farm at Coram , which is reached by an improved dirt road runn ing eight-tenth s of a mile through property owned by the . highway su- perintendent. Records in the county clerk' s offi-ce at Riverhead show that a deed for the site of the sand pit was recorded in Mr. Terry ' s name on May 29 , 1939 by Mr. Da^vis. The description filed with the deed reveals that the high- way chief owns property on two sides of the pit tract , which is-bounded en the west by land formerly ofgarrison Roe \ a distance of • about \ 40 rods , th ence ' southerly by and with the sa.id Roe property about 20 rods to a stale set for a lound , thence easterl y 40 rods to said Old Road and a stake set for a bound , thence northerly toy and with said Old Road 20 rods to a stake to the point or place of begin- ning, being 80 rods to the south of tliia north boundary of prop erty of Harod d F. Davis on the west side of Odd Road. \ An identical description of the prop- erty was filed' with the Brookhaven Town Planning Board less than two month s later with an app lication which was made by Mr. Terry for a temporary permit to operate a sand and gravel pit at the site. A rough map which accomp anied the application was drawn on a daily report sheet of the highway depart- ment. It shows that the property deeded to Terry for the sand pit was a parcel oi land carv-ed out of tie northern boundary of the Davis farm. The Davis residence is also indicated on the map, On the recommendation of the Zon- ing Board of Appeals the [planning board issued a temporary p-ermit to Terry for . operation of a sand and gravel pit on July 7 , 1939 , for a two- year period. When a temporary per- mit is granted it is not ne-cesfeary for the owner of the .property . to be desig- nated. - \}>—— -- ¦—- * \Y l Entrance Th rough Davis Place | ^____ - ¦ : — - ¦» The..only apparent , entrance to the sand pit is a curved driveway between Davis 7 , residence, and the clubhouse on Davis- ' property which was erected for use of the highway emp loyees. This connects with what is described as Old Road in the app lication , but Old Road does not show on.the school map. . There is evidence that this 20-foot road has been improved since the pit was opened , althou gh it seems to end a t. the sand pit. There is a farm road winding through plowed fields which leads from the pit north of the Davis prop- erty for six-tenth s of a mile and even- tually connecting wi th Mount ' Sinai road. Mr. Terry ' s application for the sand pit . indicated that the road was already in existence since it stated , \together with a right of way south- erly, thence easterly 20 feet in width over the said Old Road to the Mount Sinai road. \ According to the p lan- ning board no authority could be given in the app lication for improve- ment of the road. Thomas E. Terry is listed on the highway department payroll at the Town hall as being employed for \truck and driver hirs \ and \ grader , no . operator , \ which means that ho furnishes a grader used by the town for highway work . ' Records at the county clerk' s office at Riverhead reveal that this Terry is ; connected with the Allco Concrete Products company, located on Orchard road , East Patchogue , which sells concrete blocks to the Town Highway department. Other members of the company are Edmund Bullock , Fred Weiss , . Joseph Mala and Mrs. Alice Ferrer. It was learned that Mr. Underwood purchased a san d pit located on B-eav - er Dam road , Bellport , from the es- tate of Anthony Fuoco in March , 1939 , for $625 , two months before Superin- tendent Davis deeded his property to Terry for similar use. Mr. Underwood also paid the taxes on the prop erty for 1939. Bills at the Town hall show that Mr. Underwood has delivered several thousand yards of sand to the town since April , 1S40 , for which he re- ceived more \than -$3 , 000. Records prior to that date are in the posses- sion of the district attorney ' s office which is continuing the investigation of the department. i i. A Choice Material , Common Use | &- : <g! One of the bills , No. 184 , which was paid on February 19 , 1941 , shows that Mr. Underwood sold 400 yards of screened sand to the town at $1.30 a yard. The sand was delivered to Bellport , Brookhaven , North Patch - ogue and Blue Point . From the deliv- ery dates it is presumed ^ that the screened sand was used to \ sand icy roads. Dealers point out that screened sand , which is expensive , is normally used for mixing cement and that or- , dinary loam, and: sand which can be purchased for 15 to 20 cents a yard is generally adequate for sanding icy, roads. Screened-sand can. be obtained , in the op en market, for 40 to- 60.centSf a cubic . yard , as . compared .to the- Underwood-.price of $1.30 , dealers and? builders say. , _ It was recently, revealed . that Mri; Underwood was one of s everaL. br . ok-**>- ers who made a profit of mer*? thar?-- $1> 000 a carload on cut-back asphgR- materal sold -to the highway depart - , ment. It was learned that , Mr. Un-£ derwood appeared at the Town hall over the week-end and demanded ,pay-r ment for a recent carload , of the- materdal he had sold. Evidence that both the Terry andr Underwood, pits have been used ¦ •-i n , recent months was -g iven by one truck, driver who said he had carted sandv with 10 or 12 other- truck drivers f during the middle of January. The , drivers were instructed , to go to the \Terry p it\ for some of the sand* , and also took sand from Underwood' s - pit to road sections in . the East Pat-r chogue-Brookhaven area. He said he. has carted sand from the Terry p it* for the past three years. It was also learned that sand was v purchased by the town three years; ago from a private pit across the r road from the town pit on the Miller,; Place-Coram road. Both of these , pits were closed prior to the Under . -. wood-Terry purchases. § —: ¦ €> , I Reminders of Election j <»- ¦ 3> During the election year of 1939! sand was dumped along numerous roadsides in the town , on promises of . improvement , particularly in the vi- cinity of Mastic , and has lain there : for three years without the roads . be- ing ' oiled. Because of weather con- i ditions and grass and weeds growing* around the sand the heaps have be-; come practically useless. Bills examined in the supervisor ' s office show that on January 11 , 1941 , the town paid $168.45 to Thomas E- J Terry for 979 cubic yards of sand and loam which was delivered in October of 1940 , at 15 and 20 cents a yard- On April 12 , 1941 , the town paid- Terry $2 , 370.38 for 1 , 053 % yards of; grit at $2.25 a yard , which was billed . as having been , delivered to Holtsville , Coram and Lake Grove. A bill submitted by the Allco Pro- ducts company and signed by thisi • same Terry, was for $183 .23 for con- ' crete blocks delivered to the town in March , 1941. On April 11 another bill for concrete blocks costing $118.27, was submitted by him for the same company. Such town bills have to be accom- panied by an affidavit by an official of the concern making the sale , stat- ing personal knowledge of the deliv- ery. This indicates how intimate Thomas E. Terry ' s position is in the Allco Products company. TOWN PLANNING BOARD'S QUARTERS TO BE EXTENDED ¦ At the Brookhaven Town board meeting last week it was voted to increase the size of the headquarters of the Town Planning board by rent- ing the vacant room next to the Plan- ning board' s present three-room*office on East Main street , Patchogue , for an additional ?20 a month . The board is now paying $40 a month . Parkway Extens ion Contract to Weston \ Bids were opened May 7 in Al- bany by the New York State Depart- ment of Public Works for a contract for the construction of the Southern State parkwa y pavement from the ' Babylon-Farmingdale road easterly to Belmont Lake State p ark in ' the Town of Bab ylon . It provides for the paying of two concrete roadways di- vided by a center jjrass mall and in- cidental work on the three-mile sec- tion. The low bidder was Andrew Weston company of Woodmere , at •1-478 , 437,35. ¦ ¦ *> . , All bridges , eliminating road cross- ings , havo been completed under for- mer contracts. The new extension ' , will provide a direct parkway route, from New York City to Belmont lake; park north of Babylon. Work is to - be compl eted this fall. ' ' William J. E.
