Buys From Atty. Underwood and Welch of Riverhead Gain of 157 P.C. Without Handling — Empty Drums Purchased at Fancy Prices By Special Correspondent Hi g hway Superintendent Harold F. Davis is buying car- loads of cut-back material used for repairing roads in Brook- haven town through brokers at 18 cents a gallon while the same materials are available in the open market for seven cents. The markup on a single c ar- load has been more than $1 , - 000. This was learned from the record of bills available at the office of Su- pervisor Edgar A. Sharp in Patch- ogue. Three carloads of this mate- rial have been bough t since January 1 , one being purchased from William L. Underwood , Patchogue attorney, who spoke for the highway superin- tendent at a recent discussion on his $62 , 248 budget deficit for 1939 and was his attorney of record in the law- suit attempting to force payment of the deficit items. Another oil dealer , that sold two carloads of cut-back to the town at profit of more than $1 , 000 a car , is. ( Continued on page 9) Judge Dismisses Carleton Edwar ds Road Charge Case The first degree grand larceny charge , on which Carleton Edwards of Middle Island went on trial yester- day at Riverhead , was dismissed this morning by County Judge L. Barron Hill on motion of Defense Attorney Stephen Callaghan , former Supreme Court .justice. The motion was made late yester- day at the close of the people ' s case , which was presented by Assistant District Attorney Harry Brenner. The defense did not present its case at the trial. Edwards , who operated his truck under contract with the Brookhaven Highway department , was one of three Brookhaven town men arrested in connection with the grand jury investi gation started a year ago into highway units in Suffolk. It was al- leged ,-ihat in March , 1940 , he com- mitted grand larceny and that he. also presented a fraudulent bil l for payment , Another one of the three , Howard Perry of Port Jefferson , - former chief clerk of the town highway department , recently was tried for fraud , but the trial ended in a jury disagreement. He is to be retried within a few weeks. The third member of the group, Frank Runimcl of Lake Ronkonkoma , plead- ed guilty as charged , but has nol been sentenced.
