Following tie filing of the amend- ed application , which will be con- sidered at a hearing in ' Mineola on January 8 and 9 , Nassau and Suf- folk legal representatives expressed increasingly determined opposition on the claim that more concentrated pumping of ground water would deplete the underground stores fast- er than replenishment by rain could take place. While the application is for per- mission to take 50-million additional gallons of wa ter daily from Nassau county, it was brought out that water level s in Western Suffolk county had been lowered perceptibly in con- junction with the lowering of levels, in Brooklyn some years ago . The point was made to prove that ¦water taken from Nassau would also affect Suffolk' s supply. For this reason , Suffolk' s Board of Super- visors is represented by special coun- sel , G\«y O. Walser of Bay Shore , at the commission ' s hearing. The immediate effect the amended plans had on the host of objectors represented at the hearing was a request from opposition counsel that opportunity be given for filing a new brief to sup-port a new motion to dismiss the city ' s app lication. In objecting to interim motions , counsel .^ for the city, John Suglia , said tlie city had amended its orig- inal app lication because it was faced with an emergency, and that if the proceedings were unduly delayed \th e emergency might be over. \ \Th at is exactly what we th i nk , too , \ replied Nassau Attorney Mar- cus B. Christ , chief opposing counsel. The city ' s amended application eliminates a. number of proposed wells sought in the first petition. These would be situated on the South Shore of Nassau from Lyn- brook to the Amityville boundary line along the city ' s right-of-way. Even though the number of wells was reduced , the remaining ones were rated to produce as much water as the original 50. In the announcement that the hear- ing will be resumed January 8 and 9 , it was indicate d that two weeks will tken be given to the objectors to prepare a brief supporting an- other motion to dismiss the city ' s application.
