Sullivan. The referee ruled that it was not a criminal proceeding and compelled the judge to testify. When the report came before the Ap- pellate Division. the judges of that ‘court sent it back to the referee. ruling that under the constitution Judge Mc- Aleese should not have been compelled to testify. and ordered his tr-stimony together with alt testimony taken after he was compelled to testify. stricken from the record. In Judge Kene snpplenientary report on the complaint of Mayor Reed, he finds that Judge .\lc.-‘tleese kept an accurate account of all fees and lines and moneys collected by him in a man- ner that would satisfy the most rigid scrutiny of an expert accountant. and that his records in that respect were of such a character that would bring down the praise of any mercantile‘ establishment doing business any-; where. And it was further decreed. the seal of the Court being placed on such de- cree. after a careful analysis of all the evidence adduced before said Hon. Bernard J. McAieese, as recorded by one John A. Toomey. the same being the official court stenographer. that the defendant. John Rudyk. had no guile in his heart. neither was he possessed of malice aforethought. as set forth by the constabulary of which one Roy Giison is trojan chief. at the time that the aforementioned John Rudyk demanded of one Mrs. Ewa- chow that she surrender into his keep- ing. as a preliminary to wedlock the aforesaid Miss Mlehnlila Lisak, en- forcing his demand It the point of a revolver pressed close to the obdurate heart of said Mrs. Ewnchow, who. it was shown on the record. faced a tragic end should she refuse to yield up Rudyk's The evidence seemed overwhelming on the part of the constabulary. Mr. Rollins has time and time again diverted his gaze in the dl~ rectlon of the Milky Way to things pertaining to mother earth. devoting no small part of his busy life to \earthquakes and the wabbiing of the poles\ and the foreteiling of earth- quakes. He predicted the San Francisco earthquake seven years ago. That dire happening is still fresh in the minds of the public and especially of those who fortunately passed through that civvfiii oataciysm. Here it was that that most eminent of counsel. John W. O'Connor. faced the embattled towers of the law. He declared the code unconstitutional. tore to shreds the structure of evi- dence set up by the constahulary as untenable. irrelevant and immaterial. The learned lawyer. who has burned tons of oil delving into the intricacies of Blackstone‘: works as lald down in law had little trouble in satisfying the court that Rudyk was within his legal right in rear-hing a mate via the revolver. On Saturday afternoon it theater party was given by the faculty or the High School to Miss Mildred Davis and Miss Wright. who leave the Flu- deii school this year. Miss Wright to go to the Fredonla school and Miss Davis to 8 school in Buffalo. They were both popular and emclent teach- ers and will be greatly missed. After the theater party they were enter- tained at dinner by Miss Gertrude Post at her home in Central Park.
