' x»V New law protects homeowners when banks fail to pay their taxes Freeporter Karcrt Downs is one of many residents who arc very pleased about a'ncw la^ penalizing banks that fail to mske property tax payments out of escrow accounts in a timely manner. ' , ■ ■ As a result of a new law^ which took . effect on June 1, 1990, homeowners w ill be protected from penalties, interest and possible foreclosures on their homes caused by the failure of m o rtgage.lenders to make tim e ly ' payments o f their properly taxes, announced State Senator Norman J.. Levy. ‘ , Senator Levy explained that under the terms o f the new bw , i f a mortgage escrow agent fa ils to pay the homeowners property taxes within a month after the interest-free payment period, Ux collectors arc now required to notify the homeowner that the taxes have not been paid. Homeowners, in turn, would then be able to make arrangements to have their bank or escrow agent make the required lax payment Mr. Levy said that the new law is aimed at preventing situations in which hom eowners, b e lie v in g that their property taxes had been paid from their escrow, account, suddenly find themselves facing a large, unpaid tax b ill, severe penalties and ipicresi charges, and in some cases, the possibility o f foreclosure for . non^yment o f their taxes. , The new bw , which applies to all one to six fa m ily owner^occupied residences, w ill permit homeowners to . seek damages equal to three times the delinquent taxes, up to a total o f $6,000, if tax payments from escrow accounts are b ie by up to six months or more. In addition, the b w provides for a penally of $1,000 against mortgage in>'esiing institutions for each viobtion ' o f late paym e n t fro m the escrow accounts o f homeowners. Mortgage lenders w ill now have 30 days from the lime a tax bill is mailed to them to pay the taxes from escrow . funds, unless the taxing authority extends the period.
