Person, et al., duly Iaw-sult being tried today before Hon. Cuthbert W. Pound, as supreme court referee, at his offices over 71 Main street. The case was referred to Mr. Pound by Justice Lamber at the Oc- tober term of supreme court in this city. It is entitled Mary G., Hawkes vs. Charles F. Warren, et al. According to the Hon. Richard Crow-| ley, who appears as attorney for the plaintiff, the wction hinges on these alleged facts: Mary G. Hawkes, who is now 36 years old, was taken from a charitable institution in Buffalo when. 7 years old by Mr. and Mrs. Asa War- ren of Cambria and was, she claimed, duly adopted by them and had passed as their daughter since under name of | Mary Warren, That they had prom-i ised to make her their heir, they never | having had any children. | She was known as Grace McEwen before being taken from the Buffalo institution. On Sept. 23, 1890, she married Chas. E. Johnson, and in a comparatively short time she became divorced from Johnson, a fact which is. said to have caused her foster parents, Mr. and Mrs. Asa Warren, to disinherit her and cease to consider her their adopted daughter. Later she married Earl A. silll his wife. According to her affidavit, Mr. War- ren, before his death on Nov. 10, 1903, after his wife's death, summoned her and her husband to come and live with him until he died, again promising that she should 'be his sole heir and inherit his property. On Asa Warren's death, without leaving a will, claim to the propety of about $3,000 in value was laid by some 24 nephews, nieces and other rel- atives of the deceased and they have since kept it from Mrs. Hawkes' pos- session. She now sues these relatives of the late Asa Warren to gain posses- sion of the estate in Cambria on the «trength of her alleged adoption. The defendants hold that there was never suit. There was a large attendance of members from all parts of the county and the addresses were profitable and the exercises both interesting and en- tertaining.
