Booth, who is a smooth young mar about 30 years of age, is apparently the most unconcerned man in court. Cumberland, Md., Oct, 1%.-Thomas Hardy, deputy sheriff and an officer of ibe Baltimore and Ohio railroad, was shot and killed, near Brunswick, by a wain rider. Hardy was watching for suspicious characters on their way to the Hagerstown fair. Hardy attempt ed to board a box car in which he saw two men when he was shot. A white ran was arrested, but he avowed his innocence. 'Then search was made for a colored man, and John Thomas Col son of Kentucky was arrested, Stoessel and Fock Cashiered. St. Petersburg, Oct, 12.-According to a newspaper here, General Stoessel, who surrendered Port Arthur; Major General Fock, who had command of the advanced works, and Major Gen- eral Reiss, Stoessel's chief of staff, have been cashierged from the army. Eldredge of Oswego a member of the nomiv= *~ anm-mitian n as Germany's Meat Famine, Berlin, Oct. 12.-There is much evi- dence to show that Germany's meat famine is growing worse. Reports from all parts of the country make mention of the measures that are be- ing taken to abate the famine. At Eisenach it was decided to establish regular rates by the markets, and in rabbit stalls have been opened. Since horse- flesh has risen in price and dog flesh is no longer obtainable, several mu- nicipalities began the buying of car- loads of sea fish at the coast towns and selling them at cost to citizens. This expedient was first adopted at Solingen, but has now spread to vari nus Westphalian cities, to Posen and oven to Bavarian towns. -- BATAVIA LAWYER? I$ DISBARRED Rochester Oct. 12. - The appelate division of the supreme court, fourth department, sitting in this city, handed down a decision disbarring Arthur E Clark, a prominent Batavia attorney and a member of a well known West ern New York family. He acted as attorney in a large number of cases brought against telephone companies to recover damages for setting poles on private property and it was in this connection that proceedings for his disbarment were started. The court removes him from the office of at torney and counsellor at law, he is pro- hibited from practicing in the courts of this state gud his name is ordered stricken from the roll of attorneys and counseflors. Binghamton, Oct, 1%. - At an . ad- iourned meeting of the common council of this city. last evening charges were preferred against Re- enrder Watson H. Roberts and the souncil was asked to remove him un- der power to perfotm such an act con- ferred on that body by the city char- ter. The charges specify five definite al- leged acts of misconduct and neglect % to perform his official duties because of intoxication. the dates of these al- leged acts ranging from March 28 to last Friday. Three of these acts were alleged to have been committed about a week ago. The complaint also contains general charges that the recorder has at fre quent intervals during the past two years presided over the city criminal court while in an intoxicated condition. A hearing on the charges was set for Thursday evening, Oct. 19. Recorder Roberts is a Republican, sppointed three years ago by Repub. lican, common council, several mem- bers of which still sit in the present ecuncii which will have to decide this case. wn LOCATED BUT NOT ARRESTED Middictown,\ Oct. 12.-Although no frrests bave been made in the Olney murder case officers who are working on the affair say they believe the guilty persons have been located. Mrs. ingerick, who was assaulted at the time of the murder of her daughter and the Olney brcthars, is improving. She is carefully guarded at the city hospital ond is not eyen allowed to talk with her children. The next day the game was cancelled by Masen Park on orders from Principal Fosdick. This morning Manager Stagg of the Masten Park team notified Manager Smith of 'he local school team that at a meeting af the Masten Park school athletic council Wednesday evening it was de- vided to play the proposed game with Lockport High school in this city and the date for the big game has been set for next Wednesday tfternoon. Another big game has been secured for the Lockport High school football team. Syracuse High school's team will play the Lockport High school team here on Thanksgiving day. The Syracuse school baseball team was one of the two teams that broke Lockport fiigh’s long list of victories on the dia- mond last year and they hope to dupli- cate the trick at football. Hopkinsville, Ky., Oct, 1%-G, L. Campbell, the Republican nominee for gounty clerk, is suffering from a se vere case of blood poisoning in the right hand as the result of the numer- ous handshakes he has given during the last few days. His condition is serious. Mr. Campbell wore a ring which was responsible for the trouble. Shaking hands with hundreds of peo- ple caused an abrasion, which grew worse with each handshake. Clive: Waived Extradition. Baltimore, Oct. 12. - Edwin Clive, alias Jardine, arrested here on Mon- day on a charge of larceny of money and jewels valued at $1,000 from an English lady, agreed to accompany a G@etective to Canada without extradi- tion papers, Director of Oneida Railway. Vander Pilt, Jr., has been elected a director of the Onsida (electric) Railway com- lev cree cee a VALID OTHERCHARGES WILL NOT HOLD Dupeste 1 Opinion - Advanced in Reply to Bemurrer of Packers to the Indictments Charging Conspiracy Chicago, Oct. 12.-The fiearing' of arguments on the demurrers to the in- . dictments returned by the federal grand jury against five big packing concerns and 17 of their employes, was closed yesterday, and if Judge Hum- phrey, before whom the arguments have been made, retains his present impression of the case, one-half of the indictments charging the packers with conspiracy in restraint of trade, will be sustained and the remaining counts overruled. _. When it was announced that the case had been closed, Judge Humphrey said: R \As it now looks to the court, the cad numbered counts are sufficient and the even numbered counts insufficient. There may be a change in my mind before I give my decision.\ The odd numbered indictments charge conspiracy among the defend- ants in restraint of trade. The even numbered counts charge a monopoly. The first count in the indictment is rot to be considered in the decision of Judge Humphrey, as to this count the packers are to plead not guilty and go to trial immediately. HOSPITAL LICENSES REFUSED. Proposed Incorporators Asked to Unite In One New Corporation,. Albany, Oct. 1%.-The state board of charities declined to approve cer- tificates of incorporation requested by five organizations in which they pro- pose to operate hospitals on the lower Fast side in New York city, on the ground that while that district needs more hospitals, the incorporation of so many would lead to confusion,. The proposed incorporators are asked to confer with a view toward ex- tending the facilities of hospitals op- crating on the lower East side, or to- ward uniting in one new hospital cor- poration. The hospitals seeking the board's approval are the \The Beth Jacob Joseph Hospital,\ \Carmel Hospital and Dispensary,\ \Hast Side Hospital Association,\ \St. Gregory's Free Emergency Accident Hospital and Ambulance station,\ and ~ the \Zion Hospital Association.\ . The board approved the following incorporations: St. Joseph's hospital, Far Rockaway, Willing Helpers' Home for Women and Jewish hospital for Deformities and Joint Diseases of New York, and disapproved the incorporation of the Independent Educational society for Italian children of New York A If cense was granted to the Schenectady Day Nursery Dispensary, ena cme » ASKED POLICE TO ARREST HIM Chicago, Oct.\ 12.-Louis Davis, who says he ombezzled a large amount of money from a firm in Rochester, N. Y., entered the Desplaines-street-police station here last night and asked to be taken into custody. Davis says he was employed as manager by the As- kine and Marine company, 501 Cox building, Rochester, and left there four months age to escape arrest on ac- count of his accounts being short a iarge amount of money. Davis is 55 years old and says he is anxious to re- turn to Rochester and stand trial, He is married and has a wife and three daughters living at 41 Savannah street, fHochester. A desire to seo his family again is the reason given by him for his surrender. The Rochester police department has been asked if Davis is wantea there,.
