Gallo- way, chief of the bureau of plant in dustry; George T. Moore of that bu- roait itd two reprosentatives of an ag- rleultural publication were | present, the two last namer made charges that the wife of one of the scientists in the bureau of plant industry owned a block of stock in an Eastern concern manufacturing culture for soil inocu- lation, while the scientist was pre-| paring and rovising bulletins regard- Ing the cnrichment of farms and por- traying the culture as containing vir- wlont forms of bacteria for making poor land rich, It was alloged that publications re- vised by tho officials tended to direct tho {armors to « commercial concern supplying the material because of ex- haustlon of the gupply by the depart- mont. At tho hearing the scientist involved in the allogations admitted that his wifo ownad the stock, that the stock was to come to him in the event that ho severed hig connection with the de- partment and become the bacterologist of tho concern,, but that in the latter part of April he decided to stay with the department and that the stock was no longer held in his family. It was also alleged that the culture had been supplied by the department to the concorn mentioned in undue quintitles, the employs mentloned be- ing charged with shipping 17 pounds in a slugle day, himself prepaying ex- penges. It is said tfiat he admitted this and other shipments, The charges nre under investigation by the depart- mont. Agsistant Secretary Hays is making an Investigation Into the whole qgitoation of the value of culture. Tho persons making the charges an- nounced their intention of bringing the matter before tho president and the department of Justice,. Pockham at some length, saying; - \When Mr, Holmes was questloned about his relations with Mr. Pookham and Mr, VanRiper ho satd that they had all been on very infimate terms socially and that when ha had occasion to visit New York he frequently found that his hotel hills had been paid by Mr. VanRiper or by Mr. Peckham. Chicago, July 28.--A special to The Dally News from Owingsvillie, Kv. gaysr In a desperate encounter between the Mullins and Fleming factions of feudists, Sot Mullins, leader of the Mullins faction, has been killed; WI im Mullins wounded and Jeff Fism ing fatally hurt. Tho battle took place on Boone Fork In & lonely mountain sectlon near the bomler of Letcher and Pike countios The Mulling were led by Sol Mullins and the Flemings by Sol Fleming The two leaders opened fire on cach other and their men joined in, Sol Mullins led his followers in o fierce charge which the Flemings met with a rain of bullets. Sol and WHI Mullins felt wounded and when Jof Flemiag was seaon to fall the ba'tle ended. Tnited attention was given to the wounded but Sol Mullins died. Bender, has gained his md and secured a delay by the State clvil service commission urtil Septem- ber 11, on the hearing on the charges preferred against him by the Civil Service Reform association. Secretary gchn C. Birdseve, of the vlvil service commission, suid that as there appeared to be no need for the | commission to meet in August, and as it had asked Bender to inform it when he would be ready to go on with the examination of the charges, making it depend on his convenience as to the written Bender that the commission would not have a meeting in Albany before September 11, when it would reccive whatever he had to present. ELECTRIC ROAD WRECK, Express Train Collided: With Stationary Train. 23 PEOPLE DEAD:; MANY INJURED. First Car of Express, Crowded With People, Was Smashed and Only Six of the Occupants Escaped-First Se- rious Accident on an Electric Rail way in England. Liverpool, July 28.-An electric «x press train on the Lancashire and Yorkshire railroad, bound from Liver pool to Southport, collided last even- ing with an empty stationary train af the Hall Road station, causing the death of 23 persons and the injury of many others. The first car of the ex press, which was crowded, was smash ed to pieces and only siz of its occr- pants escaped. The road was recently given au electric equipment. This is the first serious accident that has occurred on an electric rail- way in England and it filled with hor- ror the numerous waiting passengers standing at the Hall Road station who were spectators of the disaster. The collision lifted the first car of the express completely off the steel frame and crashed it down again on the unfortunate passengers, 20 of whom were killed outright. More of them would have been killed but for the presence of mind of a Liv- erpool architect who, seeing that a collision was inevitable, shouted to his fellow passengers to throw themselves upon the floor of the car. Almost immediately after the crash the wreckage burst into flames. The mangled bodies of the dead and the cries of the injured vainly beseeching that they be extricated from the burn- ing wreckage formed a terrible scene and many women on the platform fainted. 'The victims included several womén and children. Fortunately the badly injured number comparatively few, The cause of the collision is un- known. | ENGINEER STRICKEN IN court. Jury Was Probing Death of First Man Killed by His Engine In 22 Years. ' New York, July 28.-Poillsn Elliot. an engineer on the New York Central railroad, had a stroke of.apoplexy in Coroner Berry's court in the Bronx while a jury was deliberating on th death of William D. Lasatkmann, a track walker, who was killed by El|. liot's engine on June 19. Elliot was unconscious when the foreman announced that the jury bad exonerated him. He was taken 'to the Lebanon hospital. His condition is serious, * It was brought out that Laackmann jumped in frount of Elliot's train while running from a blast which had been set off by workmen employed by the New York Central Construction com- pany. Elliot testified that he had been an engineer 22 years, but it was the first time his engine had killed any one. He was very nervous during the inquest, and five minutes after the jury retired he collapsed. The jury decided that Laackmann came to his death through the negli- gence of the construction company. ~ Question of Pythian Home., Ogdensburg, July 28.-The New York state grand lodge, Knights of Pythias, closed its sessions here last night. The matter of the establish- ment of a Pythian home, reported upon adversely by the grand chancel lor, was debated at length and finally referred to the home trustees, with power to act. The grand lodge has a fuhd of $100,000 for the purpose. Gloversville was chosen for the next grand lodge session. Only three uni- form rank companies compéted in the prize drill, the awards being as fol- lows: Auburn first, Rochester second and Oswego third. A handsome statuette was presented to retiring Grand Chancellor Holtz of Rochester. s Revenues of San Domingo. Washington, July 28.-The revenue; of the republic of Santo Domingo col- lected under the modus vivendi be- tween President Roosevelt and the Dominican government by American officials commissioned by the Domini- can government, amount to $331,648 for April and May. Of this amount there has been placed in the City Na- tional bank of New York to the credit of the trust fund for the benefit of the creditors of the republic $157,313. This money will be held until the Unit- ed States senate has taken action in the matter. Wreck on Guernsey Island.. Guernsey, Channel Islands, July 2%. -Alarge French freight steamer wont ashore on the west coast of this island. It is believed that the vessel, «lue name of which is not known wiil be n total wreck. Which Landed Hiicit o Tobacco. ‘ New York, July 28% -The steamer Diamant, from which $200,000 worth of Sumatra tobacco which was seized by government officers at Bayonne, N. J. Wednesday,-is supposed to have bsen landed, is not owned by the Standard Oil company and that company is in no way responsible for her. J., July 28. - John Faure, an Italian of No. 161 Lyon street, slashed John Scotti of No. 76 Butler street because the latter gold Faure's name and address to a girl whom Faure had insulted. Faure, who was accompanied by his wife, lay in wait for Scotti near his home. the men and was cut about the wrist. Scotti was cut in the neck and hands. Faure was captured by butchers of a beef company and placed in the cold storage vault. All the fight was chill ed out of him when the patrol wagon errived.
