Upou his trial in the court of sessions; pres mded over by the county judge, it was held that his conduct amounted in low to the guilty by the jary. 'The General Term of the Bupreme Court, consisting of Presiding Justice Dwight and Assovinte Justices Lewis, Mapomber, and Haight, have now reversed the conviction. That tribunal declared that the prosecution of the business carried on by the defendant was. not the maintenance of a- forry within the intendment of the statute. A ferry, in the legal sense, is a highway over public water, and it must teroRnate at each end in a_ highway on . the land. The Court of Appenls of this state: has de- fined a ferry to be \a cofitifuntion of the highway from oue #ide of the water oyer which it passes to the other, for the trans- portation of passengers or of trnvellers with theif teams and vehicles, and such other property ns they may carry or hive with them;\ and the English courts huve de- elnred that the terminal of n ferry nest be as towns or villages or highways leading to towns or villages. To the Mago cano this ostontial character- intl of a ferry was wanting, because the route of the defendant was not connedied with any highway on either. side of the Ni- agora river. \'He never: carried tratelers, but only excursionista, and his boat was a pleantre boat and not a ferry boat,\ > The law in this case seems so clear that it is surprising that the Court of Sessions allowed the defendant to be convicted at all.
