The board of harbor com- misloners are authorized to COIlStlfl'ICt und maintain upon the lands acqunfzd by the city of Niagara Falls, as. pro- vided in this title, all necessary docks, plers, wharfs, slips, basing, abutments, bridges, - approaches and olthqr struc- tures required to furnish at §mq city for public use, proper conungrcml tamp- ties - and shall have exclusive control and custody thereof, and have power to grant any lease or right otherwise to use aud employ the same, subject to their said control, In any manner w_1nch shall be in aid and furtherance of the public use and not incons1§tent there- with; provided that any bridge which 'shall be constructed shal be a draw- bridge, or otherwise constructed to not unnecessarily | interfere with naviga~ tlon, ind said board, for the purposes of this act, shall also have the 0X0}IISI\'0 charge and control of all the nawgab‘le waters of the Niagara river within said city above the falls. , Sec. 207. Upon the request of the board of harbor commissioners the com- mon council shall raise, not exceeding one hundred thousand dollars, upon the credit of the city of Niagara Falls, und cause the bonds of said city to be issued and negotiated therefor at not tess than par; which said bonds shall be excocuted and negotiated as fre all other;, bonds of said city, except that they shall also be countersigned by the president of said board, and be made payable, the principal thereof, not ex- ceeding forty years from their date, and the interest at uct exceeding four per centum per annum, semi-annually, rt r: specific time and place stated therein; said money shall be expended only to provide, construct and maintain the docks, piers, wharfs ,slips, basins, bridges and approaches thereto which sald board shall deem necessary for the public use at said city, and shall be raiged as aforesaid in such amouts and nt such times as said board shall re- quire the same in the progress of said work, All such moneys and all moneys which may be received by said board from rentals or otherwise, shall be de- posited | with the city | treasurer forth. with, to the credit of the harbor fund, struc- j and shall be drawn out only upon the order of the president of said board, countersigned by its secretary, to pay for the expenses of construction and maintenance - of such docks, wharfs, piers, slips, bridges and basins, and the care and custody thereof, including the compensation of the employes of said board and the harbor master, and the city | treasurer shall pay from said moneys. by check or otherwise, any order - drawn upon him, signed and countersigned as aforesaid, and not otherwise. See. 298. The city treasurer each year shall set apart from the moneys re- ceived by him to the credit of the har- bor fund, other than the proceeds of bonds provided for in the last section, n sum equil to one-fortieth part of the principal of said bonds then outstand- ing. which shall constitute a - sinking fund, and be used for the payment of such bonds and for no other purpose, 'The city treasurer shall invest the moneys of said sinking fund to obtain the largest possible interest thereon consistent with safety,and the interest so received shall be applied to pay the interest of said bonds, if any, and any baltmee of said interest as the same may acerue, and of said principal of said bonds when due, shall be paid by said city as the interest and principal of its other city bonds are paid, and the common council shall annually cause the amount necessary therefor to be levied and raised by tax in time to pay the same when due. See. 209. For any work or construc- tion which the board of harbor commis- gioners may require or authorize in the performance of their duties, said board shall advertise for bids, and shall have power to reject any and all bids there- for which may be received; provided, however, that if any bids is accepted it shall be that of the lowest responsible bidder whose bid conforms to the re- quirements of said board. In case any bid shall be approved said board shall contract with the bidder for such work in writing, executed in triplicate, cne of which shall be filed with the city clerk, one with the secretary of said board, and the other delivered to the contrac- tor. 'The person taking such contract shall execute a bond to the city with surities for the faithful performance of the same, which shall be approved by said board as to form, amount and sufficiency. No member of said board or person connected with the city gov- ernment shall be interested, directly or indirectly, in any contract with the said board, and a contract made in violation hereof shall be void. See. 300. 'The rates and charges for leases, rental, dock privileges and other 'use of said harbor improvements for each ensuing year shall be fixed by the board of harbor commissioners during each December to begin January first next thereafter except in any case where such rates or charges shall have been fixed for a longer term. See. 301.) 'The board of harbor com- missioners are authorized to fix the fees of the harbor master and to make and publish rules and regulations for his government, and for the government, use and control of the properties in this title placed in their charge, and to fix and designate a penalty for the viola- tion of any such rule or regulation, and any penalty so fixed and designated that shall be incurred shall be recover ed by action in the name of the city of Niagara Falls, and any claim which at any time may be due and existing for rents or revenues of any of said prop- erties shall also be recovered by action in the name of said city. Al such re- coveries, when collected, shall be plac- ed by the city trasurer to the credit of said board. See. 302. The board of harbor com- missioners are authorized to appoint, employ, and at pleasure remove, a har- bor master and other necessary em- ployes, to prescribe their duties and fix their compensation, See. 303. The board of harbor com- missioners shall make a report annual- ly to the mayor and - common council, which shall be verified as to its cor- rectness by the president or secretary and filed with the city clerk at least ten days and not more than thirty days before cach charter election, set- ting forth in detail the money received and expended and the sources and pur- poses thereof, and date and times of payment of all obligations incurred and the extent. progress, cost and condition | of finy work done by said board, and any failure to make and file such re- ports shall be cause for which the mayor may remove such president or secretary or both. Churchil} and son closed its dors. 'The deposits are about $40,000 and will probably be a total loss. Last night creditors met and demanded an explanation. C. J. Church had left town, his son Charles A. Church, refused to attend the meeting pleading illness. This morning the sheriff went to young Church's house to get the bank keys. Church saw him and shot his young wife as she arose from bed. She will die. He then shot himself dead. H. Presented \‘Vith~ Flowers. New Grand Hotel, Summit Mountain, N. Y., Aug. 25.-¥fr. and Mis. Bryan arrived here at 10:30 o'clock this morn- ing. Along the route people from board- ing houses and farm houses presented Mrs. Bryan with flowers. The prison in the Carary Islands are conducted on a somewhat lax principle and the inmates allowed to meet to- gether in the yard. An allowance of 0.50 pesetas per diem is made to each prisoner, and he is allowed to feed at a cominon mess or provide his food for himself.
