Judge Seeds Ordered Military Prison- «ft Turned Over to Civil Authprlfcle* * Oripple Oreelf, Col., Sept. 25,—Irt the district court Judge Seeds overruled the motion to quash in the case ot four military prisoners for wboin, writs p£ habeas corpus were issued recently, and ordered the prisoners turned wer to the civil authorities. Judge Bceds said that he could not lubscribo to the doctrine that the mili- tary waa supreme and not amenable to the court, because to do so would mean to overthrow free government and substitute a monarchy. Ho held that no evidence bad been preiented that law breakers would not bo prosecuted and punished by the civil authorities. Judge Seeds also 'strongly robuked Jtho presence of troops la the court- room. • , General Chase declined to obey tbo order of the court, but It Is understood hero that Governor Peabody will In- struct him to turn the prlsonew over to the civil authorities. \Ac habeas corpus prflcedlngB were the result of recent mine striken here, during which troops wero called oat to maintain order.
