Eptror Tromas:-In the Oct, 12 is- sue of your paper I notice that you in- sert an article, which, I think, just appeared in the N. Y. 'Times, relative to a decision of the Appeleate Division of the Supremé Court, in which the opinion was written by Judge Parker, This decision had reference to marked ballots. - It has been criticised and misinterpreted | by several | writers, article above referred to. The decision and the opinion with them, however, give no warrant for the claims made in that article. I will quote from the-opinion which may be seen in full in 19 Appeleate Di- yision 487. | \The sole question upon which the validity of the ballots in question turns is whether a voter who desires to vote for candidates of differ- ent parties, must place the cross X mark in the 'voting space', so called, opposite the name of the candidate for whom he would vote; or whether it will be be sufficient if he place it be- fore the name of each candidate, but not within 'the voting space.
