Tke \People of the State o f New-York, represented in Senate and Assembly, do enact as follows: § 1. A ll able bodied whi;e m ale c itizens between the ages of eighteen and forty-five y ears residing in this s t a t e and n o t exempted by the laws ofthe Unked States, and the provisions of this act, shall be subject to.milifary duty, excepting, _ 1. Officers of the arm y of tbe United States; 2. Ministers and preachers oi the gospel; 3. Persons who have been or hereaiier shall be regularly discharged in consequence Of the perfor mance of m ilitary duty, in pursuance of a n y law of this state, and such firemen as are now exempt by law; 4. Commissioned officers who shall serve as such in the m ilitia of thisstateor in any one ol the Uni ted States for the space of five y e a rs; but no such officer shall be so exempt, unless hy his resignation a f t e r su c h te r m o f se r v i c e d u ly ac c e p te d , or in so m e other l a w f u l m a n n e r , he shall h a v e been honorably disch a r g e d ; 5. Every non-commissioned officer, musician and private of every uniform company or troop raised or h ereafter to be raised, who h a s orshail hereafter- uniform himself, and' whose term of service in such company or troop shall amount to seven years from the time ol his enrolment therein shall be exempt from m ilitary duty, except in cases o f war and in surrection. 6. A l l persons except com m issioned or w a r r a n t officers a n d m e m b e r s o f u n i f o r m e d com p a n i e s duly o r g a n i z e d w h o shall a n n u a l l y com m u t e for m ili tary duty by p a y i n g to the collector or. r e c e i v e r o f the town or w a r d in w h i c h lie resides the su m o f seventy-five cents, between t h e first d a y of M a y an d the first d a y o f N o v e m b e r in each y e a r ; such col lector o r receiv e r shall give duplicate r e c e ipts therefor, and such receipts or' his return thereof, sh a l l b e t h e . s o l e evidence of such exem p ti o n , and w h e r e one o f s u c h duplicates s h a ll-have been d e l i v ered to the com m a n d a n t o f t h e c o m p a n y . w i t h i n the bounds o f w h i c h su c h person sh a l l reside, s u c h persons shall not be r e t u r n e d or fined for a n y de linquency o r dtficiency in respect to any m i l i t a r y , rendezvous parade o r t r a i n i n g d u r i n g the y e a r in w h i c h such certificate w a s g i v e n ; 7. Any member of rhe religious society offriends, or other person having conscientious scruples a- gainst doing military service, may at any time, be tween the first day of May and fifteenth day ol Au-. gust in each year, d eliver to an assessor of the town or ward in which he resides, an oath or affirmation, in writing, that he has conscientious scruples a- gainst doing m ilitary service, which oath or affirm ation may be made before any assessor or justice ofthe peace; such oath or affirmation shall be filed and preserved by the said assessor; and such as- sts-ior shall give lo the person m aking such oath or affirmation, duplicate certificates that such person has delivered to him such an oath or affirmation; and shall also when the assessment roll o f h is town or ward for that year is completedj annex to the same a list o f a ll persons who have filed with him the aforesaid'oath o r affirm ation; and (hereupon the same proceedings shall be had for the collec tion of the sum of seventy-five cents, from each of said persons, as are directed and authorized by the provisions of chapter tenth of the first p art o f the- Revised Statutes, in respect to the collection ol a commutation of lour dollars from persons who should elect to commute for the performance of military duty, as provided for fn that chapter; and the board oi supervisors shall issue their w a rrant ior collection thereof, in th e m anner specified in such chapter; such assessors for taking such oath or affirmation and giving such certificate shall be entitled to a tee ol twelve and a half cents, to be’ )aid by the person, entitled to said certificate; the m a k i n g and deliverin g o f s u c h oath o r affirm a ti o n shall not excuse the p e r s . n m a k i n g the sam e from doing m i l i t a r y duty; unless he s h a l l deliv e r one o f the said duplicate certificates so t o b e given by the assessor to the com m a n d a n t of his com p a n y before the t w e n t i e t h day o f A u g u s t o f the y e a r for which such certificate w a s given, no person n a m e d in an y such certificate shall be bound to a p p e a r a t any p a rade, or be r e t u r n e d to a n y court m a r t i a l f o r n o t do in g m i l i t a r y duty lor the year for w h i c h such certi ficate w a s g i v e n ; the su m s to be collected as com mutations by the collectors u n d e r this section shall be paid by the collectors to the cou n t y t r e a s u r e r . § 2. A l l able bodied w h i l e m a l e citizens between the a g e s o f e i g h t e e n and forty-five years, n o t e x e m p t >y the law s o f the U n i t e d States, shall be enrol ed b y t h e co m m a n d i n g officer o f t h e com p a n y district in w h i c h t h e y sh a l l respectively reside, a n d - r e p o r t the s a m e i n an alp h a b e t i c a l list to the i n s p e c t o r of his brigade. §3. T h e com m a n d e r - i n - c h i e f s h a l l c a u s e t h e s t a t e to b e divided into eight m i l i t a r y d i v i s i o n districts, according to population, describing the boundaries thereof; w h ich description s h a l l be pu b l i f h e d and filed i n the ad j u t a n t - g e n e r a l ’s office, a n d tra n s c r i b i n g a book to be k e p t f o r ihat purpose. § 4. As- soon as the boundaries of such division or distrier shall be completed and filed in the adju tant-general’s office, the comm ander-in-chief shall direct the majorrgeneral of infantry highest in rank, residing in the bounds ol a n y such division and then iu commission, to divide his division dristrict into two brigade districts, according to population. T h e c h a i r m a n u f t h e - m e e t i n g after d e c l a r ing the result, shall give notice by proclamation to the m e m b e r s o f s u c h com p a n y t h a t a n election w i l l be-held for the choice o f s u itable persons to fill the offices in such com p a n y . s 17. To every such company there shall be one captain, one first; one second lieutenant, four ser geants and four corporals § 18. Such chairman shall pieside a t such elec tion in the same m anner and with the same powers, and shali perform she same duties and make the like returns as the commandant of brigade is now required by law. § 19. T h e electors, m e m b e r o f s u c h u n i f o r m com pany. shall then proceed to t h e choice of t h e i r c o m m issioned an d non-com m i s s i o n e d officers in the m a n n e r now provided by law for the c h o i c e o f m il itia officers, e.-.cept th a t it shall be com p e t e n t for su c h electors to m a k e choice oi any suitable per son subject to m i l i t a r y duty, re s i d i n g w i t h i n t n e i r district as a com m issioned officer ot s u c h district, w h e t h e r he shall hav e volunteered as a m e m b e r of such com p a n y or otherw ise, o r w h e t h e r he m a y a t the t i m e be a com m i s s i o n e d officer rendered super n u m e r a r y by this act, o r otherw ise. A n d i f by a choice o f officers f r o m the com p a n y , or from other cause, the n u m b e r o f p r i v a t e s a n d non-com m ission- cd officers s h a jl be reduced to a less n u m b e r t h a n fifty-eight, then the co m m a n d i n g officer o l the com p a n y shall r e c e i v e volunteers until th e r e are fifty- eigh t non-com m i s s i o n e d officers and p r i v a t e s in said com p a n y . § 20. Non-commissioned officers shall be chosen from the members ol the company to which they shall belong. T h e musicians, not exceeding three in number, shall be appointed by the commandant of each uniform company. 5 21. The existing uniform companies in any of the cities o f th is state w h ich shall be fully u n iform ed a t the time of the passage o f this act, and all oth er uniform companies hereafter organized ih pur suance of this act, in any such city, may consist of members residing in any of the company districts locatecTwithin such c ity,but there shall not be-more companies than there are company districts; and no company shall consist o f more than sixty-four members. T h e officers of each existing uniform company, and those hereafter organized in pursu ance of this act, in any city, shall respectively have command o f a company district within their respec tive cities, and perform all the d u ties required by this act, to be performed in any such d istrict. T h e commander in chief shall designate the company officers who stial j have command of each of such districts respectively. 5 22. The same to he furnished at the expense o f the State. 5 28. T h e cottimanding officer of e a c h regim e n t shall be. rc&pon»ible for.-the safe kfceping and return ofall arm s and equipm ents committed to liis charge, and shall exe cute s.uch bonds as the com missary-general shall require from tim e to tim e ; and.no regim ent shall be so furnished uatil bonds forthe safe-keeping a n d return, shall be made out a n d approved of by the commissary-gerieral, and until a suitable.nrmory or p la ce of d eposits shall be erected in such regim e n t. 5 29. The commanding officer of each regim ent shall appoint a suitable person to take charge of the arm o ry of his regim ent, and a ll arms and equipments and other p ro perty o f th e state therein deposited, and to discharge all duties connected therew ith, as sh a llb e from time to time prescribed by the com missary-general. 5 30. Such persons so appointed shall receive a com- pensation not to erceed one dollar p e r ddy for the time actually em ployed in cleaning guns, and other duties in dispensably necessary for the safe-keeping and preserva- tipn of such property o f ihe state as shall be committed to his charge^ -U- a charges and accounts shall be audited by the commanding officer of the brigade in whose d istrict he shall reside: § 31. The Commissary-general shall from time to time m ake suchttrdersj rules and regulations as he may deem proper, for the observance of all officers having c h a rge of any armory in which arm s o f th e people of this state shall be deposited. S 32. Any person who shall wilfully injure such arm o ry or its fixtures, or any gun, sword, pistol dr other property of the state therein deposited, shall b e deem ed guilty ofa m isdemeanor. § 33. T h e com m issary-general m ay from time to'thne require any officer to examine any aruiory provided as aforesaid, and report to him the condition thereof, and of the-arm s and cam p equipage therein deposited. S 34. Ii shall be com p etent for the com missary-general to assign the supervision of the erection of such arm ories to a n y officer w ithin the bounds o f the regim ent or brigade in which the Same may be located. § 35. E v e ry officer of the line and staff, and every offi cer and private of any uniform company in this state, shall provide him s e lf with a uniform com p lete, which shall be such a s the com m ander-iu-chief shull prescribe, aud sub ject to such restrictions, limitations and alterations as he may order. § 36. T h e r e shall be one parade in every year for six consecutive d ays, by battalion, regim e n t or brigade, as the com manding officer of division shall deem most e x p e d ient to order, for the purpose of encam pm ent, traiuing, disci pline, inspection aud rev iew ; and all o ther company and regim e n tal parades h eretofore required by law, a re hereby abolished. § 37. The com m anding officer of each brigade shall o r d e r the troops u n d e r h is command to parade for the above purpose, at such place and time between the fifteenth day of August and the first day of N o v em b e r in each year, to commence on any Monday therein, as he shall deem pro per, and in the following o rder : 1. The commissioned, non-commissioned officers and musiSiahs of any battalion, regim e n t or brigade, or the different corps thereof as shall be ordered to a p p e a r a tlh e places appointed for such parade, shall m e e t at eleven o’clock in the forenoon, a n d shall not leave, without per mission, until the close ol the parade on the sixth day thereof; 2. All the uniformed privates of each com pany belong ing to each battalion, regim e n t o r b rigade or th'e different corps thereof, as the case may be, shall m e e t the officers of their respective companies at such parade, on T h u rs day, the fourth day thereof, in their respective uniforms, at ten o’clock in the forenoon of thut d ay, and shall n o t leave without permission until the t^pse o f th e parade on the sixth day th e r e o f ; 3. T h e onuniform ed privates of each \company district shall m e e t their respective uniformed companies at such parade, on Thursday,the fourth d a y o f such parade, arm e d and equipped as the law directs, at nine o’clock in the forenoon, for com pany parade, inspection, review and m artial exercise, and s h a il not leave such p a rade, without permission, until sun-down, a t w h ieh tim e they shall be dismissed. § 38. The com manding officer of the day at a n y such parade, may .cause those under-his command to perform any field or cam p duty he shall r e q u ir e ; and also to put under g u aid for the d ay or time of contiuuiug such parade, any officer or soldier who shall disobey the orders df his superior officer, o r in a n y w ise inlerrupt the exercises of the day ; also all other persons who s h a ll trespass on the parade ground, or in any way or m a n n e r interrupt or m >Icst the orderly discharge of d u 'y of those under arms, and also may prohibit ahd prevent the sale ofall spirituous, liquors, (except by licensed houses;) within one m ile of such parade or encam p m ent, and also in his \dis cretion, all -huckster or auction sales, or gam bling may be abated as nuisances; § 39. The several volunteer com panies o f c a v alry, a rtil lery, light infantry, riflemen; grenadiers and infantry, shall be num b e red in the corps to which they respective ly belong, and a record made pf such numbers in the adja- tant general’s office ; and each and every such company shall be subject to the orders of the commanding officer of the regim ents within whose bounds such company shall be located, to w h ich commanding officer the commanding officer of such company shall m a k e his proper returns an nually, as required by law ,or in orders, 5 40. E v e ry non-commissioned officer, musician and soldier o f any uniform company in this state shall be hol- dcn to do duty therein for the term of seven years from his enlistm ent, unless disability after enlistm ent, should absolutely incapacitate him to perform such du'y, or he should be regularly discharged by the proper officer, and all commissioned officers and non-commissioned officers, musicians and privates of uniformed com panies, shall be exdm pt during such tim e of service from jury duty, ancl shall be allowed two days deduction from their assessm ent of h ighw a y labor, i f so assessed. § 41. All o rders for encam pment, inspection and review* shall be .published a t least tw enty days previous to such parad e ; and all com manding officers of companies may on any parade, read brigade, regim ental, or battalion or ders nnd notify the soldiers and officers of th e ir several commands to appear as specified in said brigade or regi mental order for the purposes therein contained, whieh notice shall be a sufficient warning. § 42. E v e ry officer, non-commissioned officer, musician and ptivate of a n y uniformed company, who shall unnec essarily neglect to appear on the days and at the tim e and. place-appointed for such duty, agreeably to the provisions of this act, shall forfeit his annual pay, a n d also forfeit and pay two dollars for each and every day for such neglect ; and the c e rtificate of the commanding officer o f a n y com pany shall be received as compe'lent evidence Of such neglect or refusal to do duty as above provided, or any other duty required by this act. § 43. No company of v o lunteers in this state shall con sist ol more than sixty-four men, including a ll officers, m u sicians and privates. § 44. T h e m a y o r ofleach city, and the supervisor of each tow n to whom • th e return in th e preceding section is m ade, shall, on or before the fifteenth day of N o v e m b e r annually, m a k e o a t a com p le te list of all the persona in each uniform com p a n y who appear from said rolls lo be entitled lo be paid for militia service, and shall, after tho per diem shall be fixed by the adjutant, general and after the first day of Jan uary atonually, draw their warrants on their respect ive treasurers of each city and couniy, directing them to pay tbe amount due lo tbe persons named in said lists ; snd ths mayors and supervisors aforesaid shall return to tbe adjutant general, on or before the first day o f December annually, the lists of the persons so to be paid J and the adjutant-general shall, on or be- fore the first day of January, ascertain -from the re* turns so made to him, the amoocf of money which will be necessary to pay to eaeh officer and soldier of the uniform corps in this state, according to tbs pro- visions of this act, and submit the same to the coin* mander-in-chief, who is hereby authorised to draw in tavor o f the county and city treasurers bis warrant on the treasurer o f this stats, to b«-{i«id out o f any mon eys not otherwise appropriated, for tbe payment of any sum that may b e required-to meet the defioisnoy in apy city or county treasury for iuch purpose. ‘ § . For the purpose of warning the commission* ed, non-commissioned officers, musicians, uniformed and un-uniformed privates of any company to attend any parade or place of rendezvous required by 1*W« the co m m a n d a n t o f each com p a n y shall, at least ten days before any such parade,give notice thereof in wri ting, by posting the same up at least in ten of the most public places in his company district, specifying in such notice the platte of parade and the day on whioh each member of his company shall appear respective ly. $54. The commandant of any company may, if he shall deeni it proper, cause liis non commissioned officers to war)! personally all or any part of hia com* pany to any parade, and il sue!) notice be given Due day before any parade; shall be deemed sufficient no* tice. $ 55. Every Un-uniformed private, who shall be regularly enrolled and duly notified thereof as herein before prescribed, and who shall ndt have commuted as aforesaid, and who shall refuse or neglect to ap- pear at such parade as specified iri the proceding sec* tion, shall pay a fine of three dollars. Fof every oth* er delinquency and deficiency he shall pay the B*m0 penalties now prescribed by law. $ 56. The un-uniformed militia attached to the o* niform companies in the Several company districts in this state, who shall not have commuted as aforesaid, shall meet a t the time and place annually appointed for encampment and inspection, and shall perform all the duties required by the commanding officers of their respective companies at such encampment ot parade. $57. The commanding officer o f each company district in this state, shall, from time td time, enroll all persons subject to military duty residing within the limits of his company district, and shall without delay notify silch persons' of tbeir enrollment, ot cause it to be done by any of his subalterns or non commissioned officbis, by whom Bach notice may bo proved. J 58. Such commanding officer shall cause tho names of all such persons enrolled to be entered alpha betically in a book lo be kept by him for that purpose, designating the date of each enrollment and place of residence, also whether belonging'to the uniform dr un-uniformed militia ; and shall annually report the 'same to his brigade inspector, to enable him to report the same to the adjutant-general. $ 59. Such commanding officer shall, on or before the first day of May in every year, make oat a com* plete alphabetical list of all the persons subject to military duty residing within -his company district, (except the uniform members of liis company,) who shall have been regularly enrolled, and duly notified of the sattie ; And shaft deliverjhe same certified un der his oath to be correct and true in all respects,.ac cording to the best of his belief, to the collector of the town or ward, or td ihe receiver of taxes in aiiy city, in which any person so enrolled shall reside I Provided, liowever, tbat said list need not rsoniaiti Any bthei* riiunes than those of the persons residing !!* the town or ward or city in which such collector of receiver shall reside, w h o se d u ty it shall be to receive the same and perform all duties as hereinafter required in relation thereto. $ 60. Every person whose name shall be written on such list mentioned iri the last preceding section, who shall pay to such Collector the Commutation of seventy-five ceiits; on or before the day of the a n n u a l parade of the un-Uniformed militia, shall be exempt from doing any military duty a t any of UlC ptradCf required by liW in this state, during the year fof which it shall be paid. $ 61. It shall be the duty of such collector of re ceiver to receive such commutation money from time to time as required by this act, and to give to tfio person; so commuting, a receipt for the same, stating the town or Ward in which the same shall be so paid } whioh receipt shall be sufficient evidence to the per son paying thesame, of his exemption as aforesaid. $ 62.
