He is held here today as the m u rdered of John Mlehaeli, of Marlhorough, whO was found on the farm of Vincent Morano in th a t village with his head crushed in. H e was committed to jail here last night by Justice Alexander John son, of M arlborough, on a charge of m u rder first degree. H is case -was set down for a hearing on Thursday Malone was found sitting in a d o o r - ’’ w a y in Johnson street, Newburgh, yesterday by Officer Adams and when approached by the officer put up Q fight. H© was under the infinenos of lifluor and his clothing and face sho'wed marks of spattered hlOod. Ho denied all knowledge of the m u rder, but later adm itted he had been drinking -with IMlchaeli on the night of the m u rder and had had a few -R-ords with him because Michaeli called him a thief. He said t h a t after leaving the hotel -with M ichaeli they parted and he has not seen him since. A t the tim e of his arrest Malone was w e aring the dead m an’s h a t and an exam ination of his suit case a t the W e st (Shore station in Newburgh re vealed a suit of clothes belonging to the dead man. W h e re th e body of Michaeli was found the authorities found a l a i ^ rock covered with blood’ stains and F is their belief th a t this was the in strum e n t used th a t resulted in Mioh- aeli’s death. Today Malone refused to am>wor any questions concerning the circum stances surrounding the death; of M ichaeli. H e says he knows nothing conceml'ng the death of -the man. That some one is poisoning dogs in Franklin street seems evident today. “Tin-y”, a valuable Bos'ton bull, pet of Simon ICing’s household), is the latest victim. There' h ave been others and the neighborhood is stirred up over the m a tter. A num b e r of val uable dogs are owned thereabouts and no one knows w’ho is going to he the n e s t to be -victimized by the m alicious and cm e l person who are putting oat the poison. W ednesday night Simon King’s pet was m'issing from the yard a t 9 o’clock. At 11 o’clock he w a s foun-d in th e yard dead. “Tiny” -was a pet of the children thereabouts and Xis loss Is mourned. Bennett, contest ant. for the nom ination, was at O'ne tim? 459 votes ahead. Later this lead was reduced to 439, in th e firijt gain m ade by M'ltchel since th e r e count began. . In 'the face of the recount results to date, B e n n ett obtained an order from Justice Goff, restraining the B o ard of Elections from certifying Mitchel to the secretary of state as the Republican can'didate. R epresentatives of the D istrict A t torney’s office are keeping close watch on the re-tabulation. D istrict Attorney 'Swann had su.t>poenaed a num b e r of election officials, to be questioned in connection with fraud charges.
