T H E POKEEP!>ilE ETEN1]«H E N T E H P R 1 8 E , S H E R H A V , JVLV %7. tS9S. / I ‘ ^ THE GERMANS INDIGNANT At the Action of the Grand Lodge, K. of P.—They Threaten to Withdraw from the O^der, CATSKILL, July 27.—The German lodges of the Knights of Pythias are very indignant at the action of the Grand Lodge which closed its sessionsat Catskill on Friday. Because of the adoption of the new constitution, which prevents them from working in German, they threaten to withdraw from the order and establsh and independent body. It was decided that the next meeting should be held at Canandaigua. John F. SchlOBser of Fishkill was elected president of the board of trus tees of the Pythian Home; Henry Lem- merman of New York was re-elected treasurer, and Frank J. Martin of New York, secretary. The committee on necrology showed that a number of prominent knights had died since the last annual conTention, among them being Past Grand Chancel lor Thomas B. Isham of Brooklyn and Judge George W. Weiantof Haverstraw. The visiting brethern were loud in their praise of the work done by the local committee in preparing for and managing the details of the convention. Many of them, perhaps, have performed similar duties themselves, and they realize that it is no easy matter to over see an event of the magnitude of the one just finished in a manner so entirely satisfactory to everyone concerned. They are glad to say that Malaeska lodge contains good men, true knights and hard workers, and surely no body of men could receive higher praise. All in attendance at the convention have apparently enjoyed themselves. They have taken advantage of all the opportunities for pleasures which have been presented. About 200 knights and their families have enjoyed the beautiful trip from Catskill to the summit of the mountains via the Catskill Mountain and Otis Elevating railways. Then there have been drives and plenty of other ways and means of pleasure. AN INTERESTING POINT OF LAW. Brought Out iu the Gaieof the-Alleged Chicken Thieyeg and Decided by Jndge Barnard. A case from the recorder’s court was taken to Judge Barnard this morning to decide the interesting point of law whether a man can be put on trial the second time for an offence. The case was that of Pat Malone, “Butch” Booney and another man, who were placed on trial before Recorder Odell and a jury on Friday afternoon for stealing chickens from a Mr. Cole who lives in the lower part of the city. District Attorney Wood appeared for the people and Lawyers Bingwood, J. Morschauser and 8. H. Brown for the prisoners. The man who lost the chick ens was sworn and gave damaging evidence against the accused men. Then it was brought out that Mr. Cole had not sworn to a complaint against them and the prisoners’ counsel moved to have the jury discharged on the ground that there was no complaint charging them with any crime. The district attorney agreed to this and the jury was *iiischargecl, Recorder Odell at once making out a new warrant and complaint against the men and they were re-arrested. This morning the prisoners’ counsel applied to Judge Barnard for an order discharging the men ciainiiug that as they had once been placed on trial they could not be again placed m jeopardy for the same crime. The law provides that in a case where a trial is commenced and the jury then discharged without the prisoner’s con sent it operates as a discharge of the prisoner and he cannot be placed on trial again, but, as the motion for the discharge of the jury in this case was made by the defendant’s counsel, a new trial is regular and the motion was de nied. The alleged chicken thieves will there fore be placed on trial again at a future date. Petitions for Pavement. The injunction granted by the Su preme Court a few days since, in the matter of the Garden street pavement seems to settle, in a degree, the right of petitioners to withdraw their names. Two Newspaper Men Pass Through Fokeepsie on Their Wheels. C. P. McKoun and Samuel Stark, of Tunkhannock, Pa., who are making an extended bicycle trip, passed through Pokeepsie on their wheels. The trip is made in the interest of several maga zines and the route is as follows: Starting from Tunkhannock,Wyoming Co., Pa., July 21, going from Tunkhan- nock to Scranton,Scranton to Honesdale, Honesdale to Port Jervis, Port Jervis to' Fishkill, Fishkill to Pokeepsie, Pokeepsie to Albany, Albany to Utica, Utica to Syracuse, Syracuse to Rochester to Niagara Falls, stopping one day to take in the Falls. From the Falls to Hamilton, Canada, from Hamilton,Canada to Detroit,Mich., from Detroit to Chicago, 111., from Chicago to St. Paul, Minn., from fct. Paul to Winnepeg the capital of Mani toba, Canada, from thence to the Beaver Hills of the North West Territory, to the Rocky Buttes of Alberta, from thence to the gold moiiptains of British Columbia,from thence to the Vancouver Islands, stopping at Victoria for one Afterwards they will leave for Seattle, Washington Territory, to Tacoma, to Walla Waiia, Washington Territory, from thence to Portland, Oregon, a five days’ trip from Portland to Sacremento, Cal., thence to San Francisco, Cal , tak ing the coast to Los Angeles, to Lower California, from there taking a trip to Mt. Egiante, 4,165 feet above the sea Thence they go to La Pez, taking the boat from La Pez, Lower California to Colonia Jaliso, New Mexico, thence to Vera Cruz by wheel, by boat through the Gulf of Mexico to Havana, Cuba, from there a trip to Trinidad, where a stop of one week will be made, and while at Havana shall report the state of affairs regarding the Spanish and Cuban war for several magazines. ^ From thence they cross the Straits of Florida to Key West, Florida, from Key West they make a stop of three days at St. Augustine, Florida, from St. Augus tine to Savannah, Ga,, from there to Charleston, S. C., from Charleston to Raleigh Nr C., from Raleigh to Rich mond, Va., from Richmond to Wash ington, from there to Baltimore, from there to Philadelphia and then to Home Sweet Home.
