MONTREAL, I>ec. 16—A claim i\or damages of $^S,23o.G5 suffered by the Sin Mac Lines Ltd.. when the tug Rival caught fire in the Wei land Canal in June, 1931, is made by the liquidator of the com- pany and the Montreal Trust Com- prny in an action before Mr. Jus- tice McDonald in the Superior Court. The hearing is continuing. The action is against the Hart- ford Fire Insurance Company, (.lobe & Rutgers Fire Insurance Company and (Jlens Falls Insur- ance Company by whom the tug was insured. On June 27, 1931, the vessel took fire when one of her firemen ignited the fuel oil in her tanks, causing an explosion, it is claimed. The tug sank, but was subsequently salvaged. Submission of evidence in this ease is the first action of its kind, and follows repeated efforts on the part of the divisional code authori- ties and finally of the National Compliance Board to obtain com- pliance, all of which were unheed- ed. Affidavits of em- ployees revealed they were paid only $H.5o for working 45* or more hours a week, and that Armstrong demanded they tell inquiring pa- trons the Agreement mas being fully complied with.
