LIVING UNDER LAW FALSE CONFESSIONS Every rule of evidence goes back to som e . injustice which the rule seeks to remedy. Take confessions. A couple \ of years ago, a man confessed killing his wife and got sent up for life. Later a n o th e r m a n confessed to the sam e m u r d e r , and clearly proved the hus band's innocence. crime charged has been com mitted. . In, one case/ an officer made . a superstitious man yiew.a Vic- f tim’sbody; in another, a drug j addidt got no narcotics until h e ' “confessed.” In both cases the I courts upset the convictions.' ‘ Appellate courts have also held that forced confession* The governor pardoned the husband. Such cases do happen from time to time. Our courts have set up the rules of evidence as safeguards against false confessions. W hat makes a person confess to a crime he has not committed? A confessor may be drunk, mentally ill or mistaken; he may even think to gain fame or to. protect someone. In New York a confession of a defendant can be given in evidence against him, unless made under the influence of fear produced by threats, or unless made upon a stipulation of the district attorney, that he shall not be prosecuted therefor; but is not sufficient to warrant his conviction, with out additionil proof that the were denials of “due process” of law. Some o f these cases in volved starving a prisoner to make him confess, or keeping another from talking with his lawyer, friends or relatives; or questioning still another for hours on end. Under New Y o rk law officers must bring arrested persons before a Judge without unnec essary delay. Nou: Tht New York Stott Bar Aitodalio* •fjttt M t e*UmH ms * p*bUc ttnic*. Low Cost. . .
