Skindiver Dies In L. I. Sound BAITING HOLLOW — A 27- year-old Queens father of four young children drowned in the waters of Long Island sound off Baiting Hollow Sunday afternoon while skindiving. The victim was Edward W Cooper of Ridgewood. Mr. Cooper and his wife , Rose, and their four children , ages six years down to four months old , were living in a rented summer bunga ' ow on Oak- lev avenue , in the Woodcliff Park section here. Riverhead police said Mr. Coop- er , an A&P truck driver , and Danie \ Meyers , 23 , also of Woodcliff Park , were skindiving 200 feet off shore in 15 feet of water , when , according to Mr. Meyers , Mr. Coop- er . suddenl y surfaced , lost his mouthpiece , and then sank out of sight. Mr. Meyers told police he rushed to Mr. Cooper ' s aid , but that Mr. Cooper threshed wildlj in the water and drove him ' off. Again , Mr. Cooper rushed to the surface, Mr. Meyers said , and managed to rip his weig hted belt and lung free. But he sank im- mediately before Mr. Meyer could reach him. Mr. Meyers finally recoverei \ Mr. Cooper ' s body 20 minutes later and towed it to shore. Volunteer firemen and police worked over the body for an hour before he was pronoenced dead at 2:15 p. m. Mr. Cooper ' s wife and the young sters were watching the rescue attempt from the beach. Mrs Cooper collapsed and was treated by a phvsician. Drugstore Corp. That indictment , re- turned in August , lilfili , alleges $-1 0 , 000 worth of drugs earmarked for the county home ended up in the Bay Shore drug store , at in- stitional prices . Judgi Markewich denied a motion for dismissal of the charges against Mr. Kirkup. Eugene flo 'd of Brooklyn , attorney for (hirfinkle and Egehnan , two weeks ago asked that tlie charges against his c 'ient 1 be dismissed because they had given grand jury testimony with out signing waivers of immunity. Mr. fiold was allowed to withdraw the motion Tuesday. He did not exp lain his actions . After Judge Markewich set September 10 as the trial date for Kirkup and the two druggists, Kirkup ' s attorney Reginaltl C Smith of Riverhead , accused the druggists of causing a year ' s de- lay in the trial , with various motions for dismissal. Mr. Smith began a p lea for a quick trial , but was cut short b) Judge Markewich who told hivn to \fish or cut bait. \ \If you want an early trial I'll throw my vacation out the window and order n panel of juror * , \ Judge Markewich dee ' ared. Mr. Smith then replied he mig ht make an application for an earl\ trial. \You 'll do it now or not at all , \ the Judge asserted. \My plan: have been disrupted for one and a half years , \ he continued. \I have some right , to a little time to my- self , \ he said , pointing out he had a busy court in Manhattan. Mr. Smith in turn said he didn 't blame the judge or Mr . Silherl- ling, but \1 bhime the people who put him in this mess. He ' s had to stand around for three year: waiting for trial. It ' s not his fault , \ Mr. Smith said. Judge Markewich once again declared the trial would start September 10. \If anybody takes steps to end the Extraordinary term , I' m sure the court assigned will handle the case. If no funds are granted to Mr. Silberling, maybe the Attorney General will try the case himself. ' Mr. Silberling saiil he wi'l tr Mr. Kirkup, September 10 , no matter what the disposition of the other defendants.
