court may order a' new election, at such time and place as they shall appoint. § 49. The supreme courti if they cannot otherw ise arrive at a satisfactory result, m ay order an issue between the parties, to be made- up in such maimer and form, aud to be tried iu such court, as they shall or may perm it or direct tbe attorney-general to file an infor m ation, ui the nalure of a quo warranto, if the case be one iu which that proceeding would be com p etent and effectual. § 50. If any such issue shall be ordered, or information permitted or directed to be filed, it shall be the duty of the supreme court to m ake such further~orders in relation to the time and m o d e of pleading, fhe examination of witnesses or the parties, tlie p roduction of books and pa pers, a n d the time and pisce of trial or htaring, as shall in their judgm e n t be effectual for ex pediting the-proceedingft, saving expense to the parties, and causing a final determination to be had, w ith as little delay, as the uature of the controversy will permit. A R T I C L E T H I R D . O f the Construction o f this Title. § 51 The term “ monied corporation,” as used in this Title, sliall be construed to mean everv corporation having banking powers, or haVing the power to make loans upon pledges or deposits, or authorised by law to make in surances. § 5*2. The provisions of this Title shall be construed to apply to every such corporation, that shall h^Veafterbe created, or whose charter shall be renewed or extended , unless such cor poration shall be specially exempted from the proviiions of this T itle, iu the act creating, re newing, or extending such corporation. § l 53*..~TMjsna “ directors,” as used in this T itle, shall be construed to embrace all persons having by law, the direction, or management of the affairs of anv such corporation,by whatever nam e they may be described—in its c h a rter, or known iu law.
