pCS adopts eligibility for free and reduced price for meals Dundee Central School announced a free and reduced price meal (free milk) policy for Dundee School children. L/)cal school officials have adopted the following family eligibility criteria to assist them in determining eligibility: Food Stamp/ A FDC/ADC House holds: Households currently receiving Food Stamps or “Aid to Families with Dependent Children” or “Aid to Depen dent Children” only have to list their child’s name and food stamp or AFDC or ADC case number, print their name and address and sign the application. Other Households: With incomes at or below the amount of money listed below for their family size may be elig ible for and are urged to apply for free and/or reduced price meals (or free milk). They may do so by filling in the application forms sent home in a letter to parents. Additional copies are available at the principal’s office in each school. Applications may be submitted any time during the school year to Mrs. Evelyn Jensen, Cook Manager. If a family mem ber becomes unemployed, if the family size decreased, or if your family income increased by more than $50 per month, or $600 per year, the family must contact the school to file a new application. The form requests information needed to determine economic need based on the income and number of persons in the family. The information provided on the application will be confidential and will be used only for the purpose of determin ing eligibility. The school district does, however, have the right to verify at any time during the school year, the information on the application. If a parent does not give the school this information, the child/ children will no longer be able to receive free or reduced price meals (free milk). In certain cases, foster children are also eligible for these benefits. Under the provisions of the policy, the esignated official will review appli cations and determine eligibility. If a parent is dissatisfied with the ruling of the designated official, he/she may make a request either orally or in writing for a hearing to appeal the decision. Donald J. Avenll, Superintendent, whose address is Dundee Central School, 55 Water St., Dundee, NY 14837, has been desig nated as the Hearing Official. Hearing procedures are outlined in the policy. However, prior to initiating the hearing procedure, the parent or School Food Authority may request a conference to provide an opportunity for the parent and official to discuss the situation, present information, and obtain an explanation of the data submitted in the application or the decisions rendered. The request for a conference shall not in any way pre judice or diminish the right to a fair hearing. p m a tt y n m t t All questions on the application must be answered completely for the applica tion to be considered by the school dis trict for approval. In addition, the parent or guardian must sign the application form, certifying the information is true and correct. In the operation of child feeding pro grams, no child shall be discriminated against because of his race, sex, color, Thursday, 8/20/87 Page 7 national origin, age or handicap. If any member of a household believes they have been discriminated against, they should write to the Secretary of Agricul ture, Washington, DC 20250. A complete copy of this policy is on file in the office of the School Food Authority District Administrator where it may be reviewed by any interested persons. Our representative w ill be happy to p rovide further information. 8/20-4 AN ORDINANCE AMENDING CHAPTER 44 A R TICLE 2 ENTITLED “STREETS AND PUBLIC PLACES\ OF THE VILLAGE OF DUNDEE MUNICIPAL CODE BE IT ORDAINED by the Board of Trustees of the Village of Dundee, Yates County, New York, as follows: SECTION 44.21 SIDEWALKS TO BE KEPT CLEAN All persons owning or occupying or having charge of any properties in the Village of Dundee, shall keep the same, and any and all sidewalks adjacent to such premises, thoroughly clean from all dirt, filth, snow, ice and all unsanitary matter. In case any such person shall fail to com ply with the provisions of this Section, or remove snow or ice by 9:00 a.m. of each day that snow accumulates, it shall be the duty of the Village Board to cause the same to be cleaned and all expenses incurred shall be paid by such owner, occupany or person having charge of such pre mises as hereinafter provided. SECTION 44.22 SIDEWALKS TO BE CONSTRUCTED AND KEPT IN REPAIR A. Maintenance, notice to perform work The owner or occupant of every building or lot, and the owner or occupant of every vacant lot within the limits of the Village of Dundee, shall keep the sidewalks in front of such premises in good and sufficient repair for the general use of the public. The Village Board, by a written or prin ted notice may require the owner, occupant or agent of any premises to construct or repair any sidewalk adjacent to said premises. Construc tion of sidewalks shall be in accordance with the terms and specifications established by the Village Board. B. Performance of work by Village; assessment of costs If the owner, occupantor agent shall fail to con struct or repair the sidewalk within the time pro vided in said notice, the Village Board shall cause the sidewalk to be constructed, or re paired and such costs may be imposed and . collected against the property affected in the same manner as provided by the Law for the collection of delinquent Village taxes. C. Construction requirements for new or re placement sidewalks All new or replacement sidewalks shall be of concrete having a minimum thickness of 4 inches of Concrete and a minimum width of 42 inches. D. Sidewalk improvement program Any owner of real property situate in the Village of Dundee, New York, whose real property abutts on any public street, may be eligible for the following sidewalk replacement program here- • by established: 1. If the sidewalk is in need of repair or replace ment, the owner of said real property may make application, whether said application is volun tary or as the result of an Order of the Board of Trustees for the Village of Dundee, at Village cost to remove the existing sidewalk by making a writ ten application to the Village asking for said removal of the sidewalk and in addition indem nifying the Village from any claim, demand or cause of action arising out of or relating to the removal of said sidewalk. A fee for the filing of said application may be established by the Village Board of Trustees. The applications will be processed an acted upon in the chronological order in which they are received and the Village will perform these services only to the extent that the Village personnel, equipment, monies and assets are available, and such availability will be at the sole discretion of the Village Board of the Village of Dundee. During the removal and haul ing away of said sidewalks, the Village will main tain the subject area, but once the Village has performed this service, it will be the respon sibility of the owner to maintain the area in a safe manner until the completion of the installation of the new sidewalk. The Village will not remove or haul away sidewalks until the owner has agreed to replace them with new concrete sidewalks in accordance with the other requirements of this ordinance, which agreement must be to replace within a reasonable time not to exceed 14 days from the completion of the Village services. 2. The Village will pay 50% of the replacement cost of the new sidewalk provided that (a) said owner of said real property submits to the Village three written estimates submitted by recog- nixed and approved contractors and (b) Village will pay 50% of material cost to any landowner constructing his/her own sidewalk upon sub mission of receipts, and (c) each such expendi ture on behalf of the Village must be approved by the Board of Trustees and there must be funds actually available and budgeted for said purpose and whether or not funds are budgeted for this program shall be at the sole and absolute discre tion of the Village Board of Trustees as they shall from time to time decide. 3. Failure of the Village Board of Trustees to budget funds for repair of sidewalks shall in no way excuse any property owner from properly maintaining, repairing, constructing, or replac ing sidewalks in accordance with any order issued by the Village Board of the Village of Dun dee. It is affirmed that the services to be ren dered by the Village of Dundee will be limited to the removal and hauling away of the existing sidewalk if funds have been budgeted for said purpose as above defined in Section 44.22 D.2, and furnishing 50% of the replacement cost of the new sidewalk and that the Village will not be responsible for any grading, preparation of site, nor construction for the new sidewalk. Provision of this subdivision will be applicable only for sidewalk installations that will be done between May 1st and October 1st. 4. Said sidewalks so installed shall be subject to inspection and approval by the Village of Dun dee, New York through its designated agents and until So approved the owner shall not have ful filled his duties under the terms of this ordinance and the Village shall not make payment as above recited. 5. Within 5 days of the installation of said sidewalk the owner shall notify the Village of Dundee, New York of the same and request at said time the inspection and approval of said sidewalk. 6. The owner of any public sidewalk within the Village of Dundee shall keep the same in good repair and if he fails to do so, the Village Clerk shall notify said owner in writing by mail ad dressed to his address as shown by the Village assessment rolls demanding that said owner shall cause the sidewalk to be repaired to con form with the requirements of this Local Law within thirty (30) days of the receipt of the notice, Upon failure of said owner to repair such side walk within the said period of time, the Village of Dundee, New York may then repair said sidewalk at the owner’s expense and the Village Clerk shall bill the said owner by mail for the reason able expenditures incurred by said Village in making said installation. 7. Not later than the 14th day of January of each year the Clerk shall submit to the Board of Trus1 tees of said Village a report showing the names of any owners who have failed to pay any bill ren dered to said owners pursuant to paragraph 6 hereinbefore during the last 12 months together with the amount of said unpaid bills and the Board of Trustees upon receiving said report shall direct that said unpaid amounts be as sessed against the real property of said owner which abutts the public streets, as of the follow ing June 1 st and shall become a lien against said real property at said time and shall be collected . along with the current Village taxes. SECTION 44.23 OBSTRUCTIONS No person shall obstruct, or cause or permit to be obstructed, any sidewalk or crosswalk in the Village, by placing thereon, any boxes, barrels, goods, wares, merchandise, or other obstruc tion of any kind or nature or suspending any sign, goods, wares or merchandise across or over any walk within 8 feet of same except temporarily when loading or unloading a vehicle. SECTION 44.24 BUILDING MATERIAL No person shall place or cause to be placed in or upon any public street, lane, alley or sidewalk, any stone, brick, plank, timber, lumber or other building material, without the written permis sion of the Board of Trustees; provided, however, that such permission shall not be for a period lon ger than three months, nor authorize the obstruc tion of any sidewalk or crosswalk unless an enclosed passageway is constructed and sub ject to such other terms and conditions as the Board of Trustees may establish to safeguard the public and to minimize the interference of the public in the use of such street or other pas sage way.
