Rinaldi, 19, of 6 Sanford Aye., Troy, was ar- rested by State Police in Guilder- land on April 3 for petit larceny. She allegedly stole $133 worth of clothing from Filene's. Rinaldi was also charged with unlawful possession of marijuana for al- legedly ' possessing two mari- juana pipes. **** Ryan P. McNamara, age not available, of Johnstown, and James M. Geniti, 18, of Fonda, were arrested by State Police in Guilderland April 4 for petit larceny. They allegedly stole $79 worth of clothing from Filene's. Geniti and Kyle E. Mac- Naughton, 17, of Fonda, were also charged with fifth-degree criminal possession of stolen property for allegedly possess- ing $140 worth of clothing stolen from Dick's Sporting Goods. **** Bonita M. Michael Hoblock to set up the meeting. \At this point the State Police have no plans to withdraw from the barracks, but they said it is a possibility in the future,\ said county legislator Paul Laudato, who is counsel for Hoblock. Major Lloyd R. Wilson Jr., who oversees troopers in a 10- county area, said Tuesday, \Presently there are no plans to move any additional troopers from Guilderland. But I can't predict a year from now — '• the picture might be completely dif- ferent.\ \If the need in Guilderland remains the same,\ he said, \then things won't change.\ Currently, six troopers and a sergeant share the Guilderland barracks with four investiga- tors. The State Police have pushed for a 'closest car' agreement, in which cars are polled for their location, but Guilderland Police have relented. Closest car is used by the State Police and the Albany County Sheriffs De- partment for the Hilltowns, but is not used anywhere else in the county. Ryan said that arrangement made sense to him. \I can't think of a reason you wouldn't want closest car,\ he said. But, Ryan, noting he is just a lay- man, said he would tike to talk with Murley and Albany County Sheriff James Campbell to learn more before forming an opinion. Murley spoke yesterday about the relationship between the de- partments. He said that if a trooper hears a call and is closer to the scene, he should go. \We don't care who's going,\ Murley said. But, the chief continued, polling cars causes a delay in dispatching that he would rather not have. Murley said the town's zone system is more effi- cient — when a car in one zone is busy, dispatchers know im- mediately which car to send in- stead. \We don't want to jeopardize even another 20 seconds when we're trying to put out a call,\ he said. And if all cars are busy, Guilderland Police turn to the State Police and Albany County Sheriffs Department for backup, Murley said. The chief also questioned claims that the 911 system has lessened the call load for the State Pdtice. \911 calls are very (fewX compared to other-sails,\ httjtfd. < y' . Sgt, Mark,Jones said yester- day that, on average, 10 percent of the calls to Guilderland Police are through 911. Of those, about 5 percent are actual emergen- cies, he said. And the majority of the 5 per- cent are fire or paramedic calls, said Jones. Ironically, the April 2 meet- ing, which happened five days after an Enterprise meeting about an illegal meeting with three town board members, may have also violated a state law. Open Meetings Law prohibits a quorum (in Guilderland, three out five town board members) from discussing town business without prior notice to the pub- lic. In mentioning the meeting at the April 2 town board meeting, Supervisor William Aylward made a reference to the legality of the meeting. He asked town attorney John Bailey for an in- terpretation of the meetings law. \Certainly there was no prob- lem today...,\ Bailey said of the meeting at the trooper barracks, which Aylward, Ryan, and Councilman Richard Murray attended. \There was no prob- lem with you board members be- ing there.\ Bailey told the board members that the Open Meetings Law prohibits a majority of the board from meeting for \discussions that involve commitments or decisions.\ The same three board mem- bers had met in Aylward's office early last month for a meeting with Murley. Robert Freeman, executive di- rector of the Committee on Open Government and overseer of the Open Meetings Law, said two weeks ago that the Murley meet- ing was illegal. Asked yesterday about the State Police meeting, Freeman said, \The answer is the same. A majority has gathered to dis- cuss public business.... They were there in their capacity as government officials.\ Contacted yesterday, Bailey said he disagreed with Free- man. The status of the State Po- lice station is \clearly town business,\ he said, but added, \councilmen were only there to ask questions.\ Bailey said that board mem- bers shouldn't have to rely on their colleagues to ask the right questions or fully remember the discussion to report back. And board members also shouldn't have to call ahead to every meet- ing to ensure that two other board members won't be pre- sent, he added. Whenever three board mem- bers know they will be at a meet- ing together, said Bailey, they should ask for his legal opinion on whether it's acceptable. Still, the board may need to become better acquainted with the law, Bailey said \This bears some discussion...,\ he said. \The board doesn't take a cava- lier approach.
