Official Notice—Rabies W hereas rabies exists in Livingston County and whereas the state commissioner of health has so certified, notice is hereby given th a t the provisions of Section 25-a of Article III of the Public Health Law, are in full force and effect in the above-mentioned municipality. In accord ance w ith the provision therein contained, Sec tion 25-a of Article III is published herewith. PUBLIC HEALTH LAW—ARTICLE in Section 25-a. Prevention of the spread of rabies. W h enever the disease known as rabies shall exist in any county or in the vicinity thereof, and the state com m is sioner of health shall so certify to the health officer of such county or any consolidated health district, city, vil lage or tovtn contained therein, it shall be the d u ty of such health officer immediately to publish a notice of the existence of such disease, together with a copy of this section by publication in a newspaper generally c i r c u i t e d within such county, consolidated health district, city, vil lage or town or by nosting in several conspicuous places, or by both such publication and posting. Thereafter, until the state commissioner of health shall have certified th a t rabies no longer exists in such county, consolidated health district, city, village or town and due notice shall have been given, it shall be unlawful for any person owning, boarding or otherwise keeping or having in his custody a dog within such county, consolidated health district, city, village or tc'vn to perm it such dog to be at large else where thnn on the premises of the owner except i t be on the premises of anot’ier person w ith the knowledge and ass-nt of such other person; provided, however, t h a t sub ject fo conditions prescribed by the commissioner and In areas designated bv him, a dog which has been actively immunized against rabies may be perm itted to be a t large. Any per«on owning or harboring a dog and who shall perm it such dog to be at large in violation of the pro visions of this section Is guilty of a misdemeanor and shall be suh-ect to a fine of n o t to exceed tw enty-five dollars for the first offense and for each subsequent of fense to a fine of not less than twenty-five nor m o re than ttftv dollars or by Imprisonment In die county jail for not to exceed twenty-five days or by both _ M id fine and imprisonment. The person confining or killing .•> d^tr ii\iler the provisions of th is section shall im m ed iately re i 'i r t in writing the facts relating thereto to the Heal health officer. Such person shall not be held liable far dam ages for killing a dog found in violation of this section, provided that the facts relating thereto have been reported to the health officer as herein reiu lr e d . The local health officer shall forw a rd such report o r a copy thereof to the state departm e n t of health. A n y peace officer and any duly appointed dog warden, except w h en such peace officer or dog warden receives a salary in lieu of other compensation, shall be entitled to a fee of four dollars for each dog seized and confined and for each dog killed in the enforcement of the provisions of th is sec tion. The expenses incurred in carrying out the provisions of this section shall be paid from moneys raised or to bo raised for the suppression of rabies, as provided in section twenty-one of this chapter. The requirements of the foregoing section will continue in effect until the state commissioner of health shall have certi fied th a t rabies no longer exists in Livingston County. TRACY C.
