BE IT RESOLVED, by the Town Board of the Town of Islip, Suffolk County, New York, as follows: Section 1. There are here· by authorized for the Town of Islip, Suffolk County, New York, objects or purposes for which periods of probable usefulness of at least ten years have been determined under other subdivisions of paragraph a of Section 11.00 of the Local Finance Law, as more fully described in the current Capital Program of said Town instituted pursuant to Section 99-g of the General Municipal Law, at a maximum estimated cost of $554,000. To the extent that the details set forth in this resolution are inconsistent with any details set forth in the aforesaid Cap- ital Program of said Town, said Capital Program shall be deemed and hereby is amend· ed. Section 2. SEQR DETER· MINATION: The SEQR deter· minations for the aforesaid, to the extent required by law, are on file in the Town Comp· troller's Office. Section 3. The plan for the financing of the aforesaid maximum estimated cost shall be by the issuance of $554,000 serial bonds of said Town, hereby authorized to be issued therefor pursuant to the Local Finance Law, it being hereby detennined that the aforesaid objects or pur- poses shall consist of (but not necessarily by limited to) the following capital items: reconstruction of and improvements to various buildings, including boiler replacements; installation of alarms; and reconstruction and resurfacing of various recreational courts. Section 4. It is hereby detennined that the period of probable usefulness of the mo~do~ectsorp~ is at least ten years, pursuant to subdivision 90 of para- graph a of Section 11.00 of the Local Finance Law. It is here- by detennined that the maxi- mum maturity of said bonds will exceed five years and that, in accordance with the provisions of Chapter 413 of the Laws of 1991, no down payment is required in con- nection therewith. Section Ii. The faith and credit of said Town of Islip, Suffolk County, New York, are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same respectively become due and payable. An annual appropria- tion shall be made in each year sufficient to pay the prin- cipal of and interest on such bonds becoming due and payable in such year. There sbaD annually be levied on all the taxable real property of said Town, a tax sufficient to pay the principal of and inter- est on such bonds as the same become due and payable. Section fL Subject to the provisions of the Local Finance Law, the power to authorize thl2 issuance of and to sell bond anticipation notes in anticipation of the _ issuance and sale of the serial bonds herein authorized, inclu<ling renewals of such notes, is hereby del,egated to the Supervisor, the chief fis- cal officer. Such notes shall be of such terms, form and contents, IUd shall be sold in such manRer,\ as may be pre- scribed by said Supervisor, consistent with the provisions of the Local Fimmce Law. Section 7. All otller mat· ters except as provided here- in relating to the serial bonds herein authorized including the date, denominations, maturities and interest pay- ment dates, within the limita- tions prescribed herein and the manner of execution of the same\ including the con- solidation with other issues, and also the ability to issue serial bonds with substantial- ly level or declining debt ser- vice, shall be determined by t.he Supervisor, the chief fis- cal officer of such Town. Such bonds shall contain sub- stantially the recital of validi- ty clause provided for in Sec- tion 52.0() of the Local FinQnce Law, and shall other- wise be in such form and con- tain such recitals, in addition to those required by Section 51'.00 of the Local Finance Law, as the Supervisor shall determine consistent with the prOVisions of the Local Finance Law. Section .8. The validity of such bonds and bond antici- pation notes may be contest- ed only if: 1) Such obligations are allthorized for an oojed or purpose for which said Town is not authorized to ex:peRd monel', or 2) The provisions of law which shollld be complied witlt at the date of publication of this resolution are not substantially complied with, and an action, suit or pro· ceeding contesting such valid- ity is commenced within twenty days after the date of such publication, or 3) Suell obligations are authorized in violation of the provisions of the CollStitution.
