Once (again the c ourt roo m was crowded with i spectators and many town and coun- j ty officials were present , j In his cross-examination , tlie defense attorney drew an admission from Su- pervisor Duryea that the road oil bills were - not audited by tlie board as a whole but were approved only by Greenhalgh , a. point which Mr. Wil- kinson stressed later in a motion to dismiss the indictment. Justice of- the Peace D. Ormonde Ritchie, who was appointed to succeed former Justice Duryea when tlie latter assumed Greenhalgh ' s office on Jan- uar y 1st, was the. ' final witness for the People. He testified that at the special board meeting on January 20th , Dur- yea r . t old Greenhalgh that tlie meet- ing was being held for the purpose of giving him nn opportunity lo make an explanation, . whereupon Greenhalgh declared, according to Just ' y e Ritc hie ' s testimony: \I realize that my fate is lri the hands of the members of this board , I want to make restitution in th is matter, and if I am niven a little time I can do so . and I hope the mutter can then be dropped. \ Wo uld Make Kestiluiioii Wi th that . Supervisor Duryea said that tlie matter had been placed in the hands of the District Attorney , Justice Ritchie testified, and lie (Duryea ) doubted if it was within the power of the board to permit Greenhalgh to I make restitution. . Greenhalgh then turned to Justice Ritchie , the latter asserted and declared . \Ormonde , you ate a lawyer. -Do you know any way T can legally make restitution here?\ Ritchie said he replied by stating, that he \knew of no way in which a felony could be compromised. \ Greenhalgh asked whether the af- feuse would be a felony or a misde- meanor , according to Justice Ritchie ' s ' teslimoiry. and the latter answered that lie believed it to be a felony and Stated: \If you are involved in this tiling, my advice to you is to pay this money immediately before it gets to the grand jury, to the end that if it does get that far it will weigh heavily in your favor. \ At that point. Justice Ritchie testified . Jus tice of the Peace Arthur G. Grif- fiths turned to Grenh algh and re- marked that \ you should be kicked In the pants. \ Greennaigh' & reply. Justice Ritchie said , was to the effect that he wished Griffiths had done it. Taking over the cross-exami nation , the defense counsel asked Justice Ritchie if Uie reputation of the de- fendant prior to that time , as to honesty , truthfullness and veracit y, had been excellent.
