It featured memorabilia o f baseball history. The exhibit was open for two days to all baseball hufis, with Mickey Tangel, Babe Ruth imper sonator entering. The monies received, from admission charges and from a raffle o f some of the baseball memorabilia, was donated to the Lindenhurst American League Chal lenger Division for Handicapped Children, Sat., Nov. 6 at their baseball game. Hie Beacon is tflB^^JjBPHTewspaper of Ann Basile of Deer Park Babylon Movie theater wins tax challenge Village and Town must reduce assessment by Carolyn James The owners o f the Babylon Movie Theater have won a reduction in real property assessment after the own ers, Cablevision, filed a tax certiori or grievance. The property’s assessment went from $50,000 to $32,000 under a negotiated settlement with the Village. Under the agreement, Cablevision will not be reim bursed for the tax years 2006 through 2009, but will receive back taxes totaling $11,000 for 2010-2011. The Village is to make the first o f two payments shortly and the second payment iio’later than June 15,2011. Babylon Village attorney Joel Sikowitz said the building, which is commercial property, undergoes a different assessment process than residential property. Commercial owners can appeal their tax assessments if they can show that they are not receiving an adequate return on their investments, said Sikowitz. “Once they can show that, we are obligated under the law to ad dress the issue,” said Sikowitz. Real property owners can appeal their assessments by showing that the recorded figure is higher than the assessments o f similar homes in the area. Representing the Village in the negotiations were former Supreme Court Judge James Gowan and Vil lage Assessor Hugo Mascari. Mayor Ralph Scordino said that the agreement was a good one for the Village because Cablevision agreed to forego reimbursements for previous years. “I can tell you that our representatives negotiated as hard on behalf o f the Village residents as they would for them selves, and as if .the money was their own,” he said. In other news the Village Board: •approved the Bohlsen application for a new restau rant in the Bank o f Babylon building, which will be subject to covenants and restrictions. Sikowitz said he will be drawing up those C&Rs and present them to the board and the applicants for approval and signing. The restaurateurs can now move ahead with the reno vations o f the building, which will take up to a year to complete according to the owners; •sent New York State a revised plan o f Village roads, which increases the plan the State has on file by ap proximately a mile. Maintaining an accurate count of Village roads is important said Mayor Ralph Scordino because funding from the State and federal govern m ent is based on the amount of roads in each mu nicipality. Scordino estimates that the correct mileage count will add approximately $1,500 to the total m o n ies received; •approved a three-way stop sign for Nehring Avenue and West Gate; •announced that the Village will no longer be pro cessing passports for residents due to new regulations that make the process difficult and costly; •will be setting public hearings for the installation o f a cell tower on the top o f the Venetian Yacht Club; new regulations to “fast track” solar panel installation applications; relief from covenants and restrictions to developer Blair Mathies who is building condom ini ums on Park and South Carll Avenues. The change, if approved, will permit the developer to rent some o f the units, providing the tenants with the option to buy them. A decline in the economy has led to difficulties in the selling the units, said the Mayor.
