If a voter has heretofore registered pursuant to §2014 of the Education Law in the West Babylon Union Free School District and has voted at an annual or special district meeting in such district within the last four (4) calendar years, he or she is eligible to vote at this election. If a voter is registered and eligible to vote under Article 5 of the Election Law, he or she is also eligible to vote at this election. All other persons who wish to vote must register. AND FURTHER NOTICE IS HEREBY GIVEN, that pursuant to a rule adopted by the Board of Education in accordance with §2035 of the Education Law, any referenda or propositions to amend the budget, or otherwise to be submitted for voting at said election, must be filed with the District Clerk of the Board of Education at. the Administration Building, on or before April 20, 2010, at 5:00 P.M., prevailing timé, must be typed or printed in the English language; must be directed to the Clerk of the School District; must be signed by at least 94 qualified voters of the District (representing 5% of the number of voters who voted in the previous annual election); and must legibly state the name of each signer. However, the School Board will not entertain any petition to place before the voters any propositions the purpose of which is not within the powers of the voters to determine, which is unlawful or any proposition which fails to include a specific appropriation where the expenditure of monies is required by the proposition, or where other valid reason exists-for excluding the proposition from the ballot. AND FURTHER NOTICE IS HEREBY GIVEN, that application for absentee ballots for election of Board Members and approval of the budget may be applied for by eligible residents at the office of the Clerk of the District (Administration Offices, 10 Farmingdale Road, West Babylon, New York 11704), beginning March 30, 2010, between the hours of 8:30 A.M. and 4:00 P.M., prevailing time, Monday through Friday, except holiday in accordance with Section 2018-a of the Education Law. The completed application must be received by the District Clerk, at least seven (7) days before the election if the ballot is to be mailed to the voter, or the day before the election, if the ballot is to be delivered personally to the voter. No absentee voter’s ballot shall be canvassed unless it shall have been received in the Office of the Clerk of the School District no later than 5:00 P.M., prevailing time, on the day of the election, Tuesday, May 18, 2010. A list of all persons to whom absentee ballots shall have been issued will be available for inspection by qualified voters of the District in the said Office of the Clerk on each of the five (5) days prior to the day of election, except Saturdays, Sundays and holidays, between the hours of 8:30 A.M. and 4:00 P.M., prevailing time and shall be available at the polling place on the day of the vote. Any qualified voter may, upon examination of such list, file a written challenge of the qualifications as a voter of any person whose name appears on such list, stating the reasons for such challenge.
