Early last May, complaint was made to the Board of Trustees of Batavia, that the building corner of Main and Jackson streets, (east side) was in an unsafe condition, and accordingly the Board appoint ed a committee composed o f the best builders and masons in town, to examine the building and report as to its condition. We find the, stone foundation wall substantially without any mor tar, and the lower part thereof of poor, rotten stone, and with a bulge inward of about three inches, indi cating that the wall is split in the center, We find other minor indi cations, not necessary to detail, and was after a thorough examination of said front vvau ancj foundation, beg leave to report that the same is in our judg ment in a very bad and unsafe con dition, and liable to fall outward into the street and injure those who may be passing by on the sidewalk or street nest adjacent to said build ing. A special meeting of the Board was called to take action upon this communication, and it was agreed to have a committee wait upon the owner of the building and inform him that if he would put the prop erty in proper order no action would be taken. This was done and Mr. Doty agreed to have the building put in a safe and substantial con- our ¡merchants stores, attracted much attention irom the passers by early' yesterday morning. — Fhe National , Base Ball Leagu e, at its recent session, ruled out foul catches. Hereafter all balls caught must be flies. — The funeral of the John 1 L, McLean will be the residence of Mrs. H. J. Ensign to-morrow afternoon at 2 o’clock ! of Jonah Turner’s meat market on | Ellicott street, near South Liberty i street. He went into the market to j purchase some meat, and when he came out horse, buggy and all, had mysteriously disappeared. As yet there has been nothin So long as this building remains in its present condition the lives of all who have occasion to pass it in going to the post-office are in jeop ardy. The first heavy fall of snow, which will cause an additional weight to be 011 the roof, may be sufficient to press out the wall, and then, as there is always a continual stream of people passing on the sidewalk, a horrible accident will be chronicled, when, alas, it could have b?en so easily remedied. In case such an accident should happen, (and even at the present tune) the owner oí the building would be liable for damages for j permitting a known nuisance to ex-' ist, and it is a question whether the Board of Trustees would not also be liable on the same score. We have not made these state ments simply on hearsay, but have taken care to get our information from reliable sources. If the owner of the properly was a poor man, and unable to make the necessary improvements, we would be sorry to mention the matter, although it would be our duty to do so. But this case is different. The owner has had ample time to make the needed improvements, and is one of the wealthiest men doing, busi ness here, and having acquired his wealth in Batavia, it is only just and right that he put the property in shape. Even if tin building was safe, it has long- been unsightly, and the spirit of enterprise which has imbued our business men ought to have prompted the owner to tear it down and erect a new and hand some structure in its stead years ago.
