December 7, 2005 Planning board recommendations on proposed \planned resort district\ expected at town board hearing Thursday In the wake of another presentation by an attorney working for Preserve Associates Wednesday, the Tupper Lake Planning Board appears ready to recommend the creation and implementation of the \planned resort district\ zoning classification for the lands encompassing the Adirondack Club and Resort development. Town officials will be looking for the planning board's guidance when they convene a public hearing on the change proposed for the local land use code tomorrow evening. Making a second appearance before the planning board in almost as many weeks. Attorney Robert Sweeney, who represents Developer Mike Foxman and his partners, called the planned resort district \a very common planning and zoning district, which gives flexibility to the design\ of any development. A planned resort district zoning classification \also allows clustering of houses, which the Adirondack Park Agency favors, and helps developers preserve green space.\ \Why can't we call it a planned use district- making it more generic?\ Planning board member Jim Ellis asked him. He said he felt that in generic form, the zoning device could be used for other types of large developments in the future.\ The attorney said it could be called that, since similar models are used for various commercial, residential and industrial purposes. He also said it was called planned resort district (PRD), because it specifically lists the various amenities that are associated with resort businesses. \As it was developed, it wasn't designed to be an all purpose\ zoning device, Mr. , Sweeney told Mr. Ellis and the other planning board members. Town Attorney David Johnson said he favored calling it a resort district, because ofits specific design. No matter what form it takes, however, the complete development and all zoning issues will require planning board approval, Mr. Johnson reminded the board. Chairman Jim Larkin liked the PRD zoning classification, saying it makes the decision-making process by that board \smoother and cleaner.\ \-And it doesn't circumvent anything ...there's nothing coming in the back door,\ he said in reply to several comments he's heard. Jim Frenetic Jr. directed the board members to a list of questions thai had been prepared for their consideration by the Hudson Group, the new firm hired in recent weeks to help the planning board review the Adirondack Club and Resort's large permit application. Those questions were referred to Town Attorney Johnson for his study, prior to the recommendation to the town board at its Dec. 8 meeting. One question wanted the board to be aware that this planned land use code amendment is based on a project that hasn't yet been reviewed by them. Mr. Sweeney explained that the PRD was a generic version of a zoning category which deals with resorts. He said it was not designed specifically about this project. The attorney said anyone can request the designation of a PRD on any lands 100 acres or greater. \Any modification- regardless of how minor- would have to be presented to the full planning board for its approval,\ Mr. Sweeney advised. Jim Larkin promised that evening that before the planning board's recommendation goes to the full town board this week, it will be first reviewed by the consultants with the Hudson Group. New Village Trustee Earl Fletcher, who was one of more than a dozen people in attendance that evening, asked about the new- relationship between the planning board and the Hudson Group, which is based in Menands. N.Y. Jim Larkin explained that the company, which the planning board selected from a list of nine applicants which responded to the board's request for proposals this fall, \works for the planning board.\ The company's services will be paid for with monies that will come from Mike Foxman and his partners under an escrow account arrangement which will be finalized by the town board at its meeting this week. Town Councilman Shawn Stuart, who was also in attendance Wednesday night, said that he and other town officials had met with Mr. Foxman and his consultants upstairs in the town hall earlier that evening to \make final changes' to the escrow agreement thai will go to the board for its approval Dec. 8. The developers will deposit funds in the new escrow accounts with the town, as needed, and the Hudson Group's invoices will be paid from there. Mr. Larkin said he has invited the town board members to join them at all meetings and discussions with the Hudson Group representatives as they work through Ihe review of the Adirondack Club and Resort in upcoming months. Mayor Mickey Desmarais officially takes over office as board reorganizes for coming year With only Town ofTupper Lake Supervisor Greg LaFrance and three members of the media in attendance, the new Tupper Lake Village Board members, headed by Mayor Mickey Desmarais, met Thursday to organize for the new year. There were no surprises during the short session as the four-member board approved a number of reappointments. The open, one-year trustee seat, made vacant by Mr. Desmarais when he was elected mayor in November, was not filled that evening (see related story on page I). At the end of Thursday's meeting. Mayor Desmarais publicly (hanked former Mayor Sandie Sirader and Trustee Rene Dcwyca for their past service. \Regardless who is voted in or out of office, anyone who serves docs so for the betterment of Ihc community.\ he said. When people get home from work, they have dinner to make, kids lo tend lo and other commitments. They just don't have time lo attend meetings.
