Dr. William Wardner of Sara- nac Lake, Franklin county coroner, John Badger of Malone, acting district attorney, and Ellsworth Lawrence Jr. of Malone, district attorney-elect who takes office on January 1st, went over!, the cir- cumstances surrounding Mr. Os- hler's death. First to be questioned waa Al- bert Oshier of Faust, son of the victim, who related how he was walking Just ahead of his father, on a trail near Little Long Pond, about six miles from this village when he heard a shot and turned In. time to catch his father'as he fell. His shout brought Peter La- Due, a hunting companion, run- ning from a clump of flr trees about 40 yards away, from which he had fired the fatal shot, mis- taking the barrel of the rifle car- ried by the elder Mr. Oshier for a buck's horns. Dr. Carter Morse testified to accompanying Chief .of Police J. E. Tlmmons, Harry Cole, Herbert Dean and Matt Calnon, all of this village, to the scene of the trag- edy. Mr. Oshier had been dead about two hours when they ar- rived. His investigation disclosed that the bullet from LaDue's 30-30 rifle had struck Oshier's rifle- stock, ripping- through his left thumb and boring through the gun-stock into the upper left ab- domen. Chief Timmona testified that he paced the distance from th6 point where Mr. Oshier fell to the spot from which LaDue said he fired—46 paces away. From that point, among the evergreens, he could distinguish the men mov- ing about the body, he said. Coroner Wardner reserved de- cision in the case. While here Monday Mr. Law- rence and Mr. Badger visited the scene of the auto crash at the foot of Raymond's hill, a mile from Faust, which resulted in death of two last Sunday. Harvey Evelln. 19, of Tioga Center, N. Y., the driver, was'held on a second degree manslaughter charge. He Is out on bail until the grand Jury aits in February. * The first success on record In salvaging sunken treasure oc- curred in 1687, when silver, specie and Jewels were salvaged from a Spanish wreck in the West Indies.
