Resolved^ T h a t in our opinion, th® legislature are n o t authorised to create or alter corporations, or to appropriate thje public m onies or property,, in any other ca.ses than su c h ns are warranted by a strict construction o f ihe constitution ; anj] that considera tion s o f expediency or precedent can never justify an infraction o f the letter and spirit o f the constitu tion. Resolved , T h a t w e are in favor o f an am endm ent o f t h e constitution, vvhich shall prehibit any appro priation o f t h e pub lie m o n ies or prcperty, by the le gislature, until sanctioned by a diiec t vote o f the peo ple, except in cases of w ar or insurrection. Iu reply, permit m e to say, that I am unable pro- .perly to express m y thanks’ to the Dem o cratic Con vention, which you represent, for this most flattering testim o n y o f their respect. I feel this com p lim ent the more deeply, fo r t h e reason that such a nomination on m y part, w a s neither solicited nor desired. I had supposed that a nom ination for that ofiice might pro perly be claim ed by; and w a s ju s tly due to, som e ’o f th e towns o f this c o u n ty ; but the representatives from those tow n s having united in this request, and feeling the force o f thal maxim o f G e n . Jackson, that office should neither be solicited nor declined, I yield m y ’ private interests, and shall accept w ith pleasure and gratitude, the nom ination thus tendered.
