These actions were brought again.st Van E tten for dam a g es by the Black brothers, who claim e d t h a t V a n E tten assaulted them and they h a d each sustained dam a g e to the am o u n t of $5,000. The defendant, A'an E tten, denied this statem e n t m a d e by th e Blacks claim ing it was ju s t th e re verse, and th a t he h a d been assaulted by them . T h e ease oecuplied th e greater portion of the day and w a s bitterly contested throughout. E x - Judges H u s ton and H u n t represented the Blacks an d Allen R.
