Professor Agassiz stands alone' among prominent scientists in oppos ing the Darwinian theory of the de velopment of animal life by evolution, and for this reason he has received much local homage. But it must not be forgotten that scientific research is in its infancy in this country, and that Agassiz, a man of foreign birth, is the only noted .authority we can boast. Por this reason, he here takes the lead in. scientific inquiry, but in Europe he is Bated as a student of the second class and not Of the first, lii- deedj his reputation rests upon his specialties of glacial theories and re search in the lower animal kingdom. The doctrine of evolution needs more than one opponent to check its pi*o- gress, supported as it is by the entire body of advanced scientists in G'er- manynnd England. Notwithstanding the Chancellor's re fusal to grant the divorce, the case was sent to the Court of Errors where it has since been decided to reverse the former decision and annul the contract on the ground that the woman at the time was laboring un der an incapacity and had no power to make such a contract. The case is a very important one, not so much because the CbancclloFs opinion was reversed, but because it establishes the important principle that when fraud o f an extraordihary natur curs in a marriage contract, the : may, upon proof, be declared void tr'om the beginning.
