There shall be elected ut the next general election a county judfre, In tho respec- tive counties of this State, wliero tho term of tho present county jndgo BIIIIII expire on the first day of January, ono thousand eight hund- red ami seventy two, nnd, in the counties In whloh the term of the present county judge does not expiro on that duv, then nt the gen erul election preceding the date on which Midi term shall expiro (except in the counties of New York and Kings), who shall hold ofllcofor six years, nnd shall perform all the dutiep, nos- aess all the poweis now conferred upon county judges, or which may horcaftor be conferred, nnd shall perform all of tho duties which now j or may be hereafter imnosad by the laws of this State, provided, however, that nothing in this net contained shall uffeet the election of county judge of the county of Greene had at the general election in tho year 1870, and the said election of said county judge is hereby le- galized und confirmed for'the full term of MX years from the first day of January, 1871. j $2. Such resolution shall be immediately de- j livered by the clerk of the board of supervisors j to tho county cleric, whose duty it shall be to I filo tho same in tho office of tho clerk of said county, and keep tho same as a part of the re- cords thereof, Within ten days after such res- j olntion shall be filed in the office of such comity . clerk, he shall transmit, to the office of the sec- retary of State, to be filed and kept iti his office, ' a copy of such resolution, duly certified by him. ! The separate officer elected and perform- j ing the duties of the office of surrogate, and the legal officer discharging tho duties of county , judge and surrogateTnnd elected at the election ' provided for in this net, shall enter upon their . duties on the first, day of January next after ' suih election, mid shall hold their office for the ' term of six years from said first day of January, ' but wheic such officers shall be elected to fill i a vacancy, then they shall enter upon the dis- I charge of the duties' of the office to which ihev j have been elected immediately upon (he receipt j of the certificate of such election. | §i5. Whenever the office of county judge shall be vacant in a county having a population exceeding forty thousand, the board of super- visors of that countv, if there be a separate officer to perform the duties of the office of surrogate in said county, may resolve that there shall be no such officer in s:iidcounty,and thereupon the office of such officer shall he deemed vacant und abolished from the time the office of countv judge shall be filled; and if there be no SUCH officer, such board may re- solve that there shall be such officer in such county, in which case such officers shall be elected at the time and in the manner in all respects that the county judge in said county shall be elected. §7. The scpirute officers elected to perform the duties of tho office ot surrogate, under the fifteenth and sixteenth sections, article six of the constitution of this state, shall be denomi- nated surrogates of the respective counties. s?8. Whenever any sunogate in a county shall be precluded from acting as such in any case, by reason of interest, rilationship, by consanguinity or affinity to any party interest- ed therein, so tlu'.t. he would he excluded from being n juror, or by reason ol'being a niiness of any nill or having noted ns counsel in such case, and there are no le!*.il officers in inch county to discharge (lie duties of such surro i gate, or where such Oiiicer shall also bj ii,ca- ] paeiiatcd *Yom acting a* such surrogate by j reason oi the foregoing disabilities in the ease , of the surrogate, the coiinly judge of such ! county, or in case of his disability for kke j causes, then tho district attorney, shall possess the power and exercise jurisdiction in all re-I speets in such case as thp surrogate of such ' county would be authorised to possess and ex- : crciso were jt vol for such disability. The ' district attorney of such county, while acting I as surrogate in such case, shall be entitled to j receive the same compensation, pro rata, as the officer acting as county judge and surrogate of such county is entitled to receive, to be audited by the board of supervisors, and to be paid by the county treasurer, in the same manner as the salary of the county judge and surrogate shall be paid ; and in counties where there is a sepa- rate officer to perform tho duties of the office of surrogate, then the district attorney of such county shall receive the same compensation, pro rata, as such surrogate shall be entitled to reocivo in such county for tbe time said district, attorney shall be noting as surrogate in such cases or disability, which shall be authorix-'d by the board of supervisors, and paid as the salary of sueti separate officer elected to per- form the duties of the office of surrogate is paid §9. Also a certain other piece or parcel of land in Lowville aforesaid, commencing m the centre of the Number Three road so called, in said town, at a point where the centre line ol the Ogdensburgh, Clayton & Rome Railroad crosses the said Number Three road; thence in a north easterly direction along the centre line of said railroad ten hundred and sixteen feet, to the centre of the State road, near Charles D. Bosh- art's brick dwelling house, being a strip of land one hundred feet in width for said ten hundred and sixteen feet and extends forty feet on the westerly side from the centre line of said rail- road and sixty feet on the easterly jide of said centre line of said railroad, containing two acres and thirty-three hundredths of an acre of land.
