Towns may borrow money for bridge and highway purposes.—A propo- sition may be submitted at a regular or jro-edal town meeting in the manner pro- vided by the town law, authorising; the town t o borrow money upon its bonds, or ether obligations, to be expended for the following purposes: 1. Constructing, building, repairing or discontinuing any highway or bridge thereto, or upon Its borders. 2. Repairing or rebuilding any highway or bridge which abail at any tune be dam- aged or destroyed by the elements or otherwise, or become unsafe for public ase and travel. 8. Repairing or rebuilding any bridge Which has been condemned by the com- mission, as provided to this chapter. *. The purchase of stone crushers. Steam tollers ana traction engines. The vote, upon any such, proposition •hall be by ballot. If any suoh proposi- tion shall be adopted, the board of su- pervisors', upon tho application ot the town board, shall by resolution, authorize the town to Issue bonds not exceeding tho amount specified in said proposition, which shall be sufficient to refund and pay any temporary loan or certificate of Indebtedness, and to provide for the com- pletion ot any work authorized. Tbero shall accompany such application a state- ment signed by a majority ot the mem- bers ot the town board, and certified by the town clerk, containing* a copy- c* the proposition submitted, as above provided, the vote for and against the same* and specifying the amount which it 4a esti- mated will he reaulred to he expended, pursuant to such proposition. Xt the highway or bridge, proposed to be con- structed, built, repaired or discontinued, ts situated to two- or more towns--In the •game county, tbe boarfl ot supervisors shall, It application be made by each ot such towns, apportion the expense there- of among such towns, in such proportion as it shall deem to be just If the town adopting any such proposition shall con- tain, any portion of the land ot the forest reserve, the boss*d of supervisors shall not authorize such town toborrow mon- eys without the written approval of the forest. Such report shall be tiled In the office of the town clerk within three days after the presen- tation thereof and shall be open to pub- lic Inspection during the effice hours -ot: jiuch town clerk and a duplicate shall at tho same time be mailed to the commis- sion. A certified copy of such report shall also be filed by the supervisor with tho clerk ot the board of supervisors, who shall cause the same to be printed in the next Issue of the annual proceedings of -the board et supervisors. The town board •hall cause a oertlfied copy of the report to he published to a newspaper published to the town, or if there be none published therein, then to a newspaper published within the county and having the greatest circulation within the town. The expense ot such publication, which shall not ex- ceed ten dollars, shall be- a town, charge. The clerk et the board ot supervisors shall transmit three copies et tbe Journal of the proceedings of the board contain- ing such report to the commission and three copies to the comptroller. f 108, Highway accounts, forms and blanks.-JThe commission shall prescribe the method ot keeping town accounts of vided to this article, for highways, bridges, purchase, leasing, rental or hiio and repair ot machinery, tools and im- plements, the removal ot obstructions caused by snow, and miscellaneous pur- poses. Which shall be uniform, ss tar aa practicable, throughout the state. Buch commission may adopt'forms and blanks tor keeping such accounts. The commis- sion shall also prescribe the form ot or- der to be made by the town superin- tendent, upon the supervisor, and the form of the agreement to be entered into by the town board and town superintend- ent as provided to section one hundred and five. The town superintendent and supervisor shall keep their accounts la the method, and shall use the blanks and forms, prescribed by the commission. All number one, as above described, orders and records ot accounts shall be filed in the town clerk's office and pre- served as a part of the town records. | 109. Duty of town clerk.—It shall be the duty ot the town clerk, annually, be- tween the fifteenth day of November, and the fifteenth day et December, to trans- mit to the commission a list containing the names of each supervisor, town super- intendent, justice of the peace, town cleric assess&r and collector, showing his post office address, the date ot his ap- pointment or election and the expiration of his term of office. where the assessed valuation ot real and moneyB received and expended, as pro- personal property therein, exclusive ot ..,..*. such property to Incorporated villages, averages more than twenty-five thousand dollars for each mile of highways therein outside of such villages, the amount paid hereunder shall not exceed one-tenth of one per centum of such assessed valua- tion. 9 101 Mileage and assessed valuation.— The mileage ot highways in towns to be used in determining the amounts to be paid to Such towns under the provisions of this article shall be the tables et mile- age heretofore prepared by the state en- gineer, until the corrected tables ot mile- age prepared as provided to section fif- teen of this chapter are filed. Such tables and all corrections thereof shsll be filed with the commission and comptroller. The assessed valuation, of real property to be used in determining suoh amounts shall be the valuation thereof, equalized as provided to section one hundred and forty-one ot tins chapter, during tbe year prior to the levy ot taxes upon which is based the determination ot the amounts to be paid to the several towns, as pro- vided to this article. S MS. Payment and distribution of state money.—The comptroller shall determine the amount due to the several towns, un- der the previsions of this article, and Shall draw his warrant upon the state treasurer In favor of the county treasurer of each county for the total amount to be paid to the towns in such county, as so determined by him. and shall indicate the amount to be paid to__sach town. The county treasurer shall pay to the super- visor of each town the amount to which such town is entitled, as determined and indicated by the comptroller. No such payment shall be made until the super- visor has filed in the office ot the county treasurer a certified copy of the under- talcing given by him, as provided tn this article. 5 104. Custody ot highway moneys: un- dertaking of supervisor.—All moneys lev- ied and collected, as provided In this ar- ticle, all moneys collected as penalties un- der this chapter, or received from any other source and available for highway, bridge and miscellaneous purposes and all moneys received from-the state, as pro- vided in section one hundred and one, shall be paid to the supervisor, who shall be the custodian thereof, and accountable therefor. Before receiving any such mon- eys the supervisor shall give an under- taking to the town ta an amount to be specified by the commission and with eucn sureties, aa shall be approved by the town board, conditioned tor the faith- ful disbursement, safekeeping and account- ing of the moneys so received by him. Such undertaking shall be died ta the office of the town clerk and a certified copy thereof shall be filed ta the office ot the county treasurer before any moneys received from the state shap be paid to him, and also to the office of the commis- sion. In case of a failure of the super- visor to faithfully disburse, safely keep or account tor moneys received from the state the commission may bring an action on such bond in the name of the town. 8.105. Expenditures for repair and im- provement of highways.—The moneys lev- led and collected tor the repair and im- provement of highways, including sluices, culverts and bridges having a span of less, than five feet, and the moneys received from the state, as provided by section one hundred and one. shall be expended for the repair and improvement of such high- ways, sluices, culverts and bridges, at such places and in such manner as may be agreed upon by the town board and town superintendent. The town board and the town superintendent shall con- stitute a board for the purpose of deter- mining the places where and the maimer In which such moneys shall be expended. Such agreement Shall be written and signed in duplicate by a majority ot the -members ot the board so constituted, and shall be approved by the commission, be- fore-the same shall take effect. Construction or improvemeat ot state highways.—The state highways shall be constructed or improved by the com- mission as provided to this article. The mileage to be constructed from the amount available from the sale of bonds issued as provided by chapter faux hun- dred and sixty-nine ot the laws of nine- teen hundred and six, aa amended by chapter seven hundred and eighteen of the laws ot nineteen hundred and seven, and appropriated for the construction er improvement ot state highways, shall be equitably apportioned by tbe commission among the several counties without dis-> crimination; but not more than one-halt, of the amount appropriated each year\ from the proceeds ot the sale ot such bonds shall be expended under this article for the construction and improvement of state highways. In making the asporttanJ meni between counties the commission . shall take into consideration the mileage which may be .constructed from the amount to be expended under this arSolo In each county for the construction or im- • provement of county highways, together with the mileage ot state and county highways theretofore constructed out ot , moneys derived from the sale ot bonds is- sued as above provided. 1122. Construction or improvement ot county highways.—The county highways to be constructed or improved under this article at the Joint expense of tho state, • county and town. shaU be those high- ways in each county determined by the commission to be of sufficient public Im- portance to come within the purposes ot this chapter, so as to constitato a part ot a properly developed system of Improved market roads within the county, taking into account the use, location and value of such highways for the purposes et common traffic and travel. SutSh county highways shall be equitably apportioned by the commission among the Several , counties without discrimination, in mak- ing such apportionment the commission shall take into consideration the'toial mileage of state highways which shall bo hereafter constructed or improved to eadh county, and also the highways thereto which have been constructed or Improved prior to the taking effect ot this article from funds made available by the issue and'sale* of bonds as provided in section twelve « article seven of the constitution, BO %atj£here shall be aa equitable ttistrl- bution^s between the counties of all highways built.to\ whole or in part from such funds. * } \ftl^enminary resolution ot board of supervisors.—The board of Bupervtaors of any county: may pass a resolution stating that pubtte.interest demands the improve- ment of. a highway or section thereof wiij-ln the county, and requesting that it be constructed or improved aa provided to this article. Such resolution, ehall; con- tain a description of such lagbway or sec- tion thereof. Such highway or sactian thereof Shall not Include a portion of a highway within: a dty, nor any portion ot a highway within an idcorporated village, unless it be necessary to complete the comiectlon of such highway with a high- way already improved or to be Improved under this article. The clerk of the^ board of supervisors ehall, within ten days aft- er the passage of such a resolution, trans- mit a certifled copy thereof to the com- mlsslon. . •' • • . : ;'- 1124.
