Strong was a brakeman in the employ of the railroad oompany and on March 19,1905, the freight train upon which he was employed ran into a wash Out at a> culvert about a mileTeast of Ma- lone, the engine going down a twenty* foot embankment, killing the fireman and seriously injuring Strong. They will, therefore, now appeal to the courts to declare the law unconstitutional because it ia confiscatory. In Ohio busi- ness interest* are reported to have de- clared a similar law a failure, and at least one chamber of commerce to the State ia to petition the Legislature to repeal it.
