Proceedings of the Board o f Supervisors o f the County o f Yates, convened at the Court House in the village of Penn Yan in said County, on the 2d day of October, 1855, in pursuance of the stat ute in such case made and provided. , The Towns in said County being called by the Clerk, the follow ing persons ansWeted, as Supervisors thereof: Barrington ......... .. . Starkey................... i Torrev ................... laws of 1847, and the said application having been adjourned over until this day, and the same now coming up for action,-and due con sideration having been had, the following order was duly made, a majority of the members elected to said Board voting therefor, to wit : 11-The said board of Supervisors no.w here, pursuant to the statute in such case made and provided, hereby order and direct the Trustees of school district number eight, in the town of Benton, Yates county, to cause to bo levied and collected by tax from the taxable inhabitants of said school district the sum of one hundred and twenty-nine dollars in the same manner as other taxes are by law directed to be levied and collected in school districts, and that the same be paid over to the said York and McAlpine, when col lected, that, being the sum which, in the opinion of the Board, ought justly to be paid to said Peter York and Andrew McAlpine for the costs and expenses aforesaid. 11 On motion the Board adjourned until 9 A . M, to morrow mor ning. Mr. George W . Spencer of Benton, moved that Ambrose S. Thomas of Potter be .chosen Chairman of the Board; which mo tion not being seconded, Mr. Sisson moved that Mr. Graham act as Chairman; which motion was seconded by Charles Hubbard and carried. On motion of Mr. Sisson it was resolved that this Board will not audit any* accounts at this session of the Board. Mr. William S. Seamans presented application, map and proof 'of posting notices, <fcc., for the erection of a new town in the coun ty o f Yates from parts of Milo and Starkey, and requested action ‘of the Board thereon, which were hied. On motion the Board then adjourned until o’clock 2 P. M. AFTERNOON SESSION. Board met pursuant to last adjournment— all the Supervisors present. Mr. Hubbard moved to defer action upon the application for the 'erection of a new town in the county of Yates until the adjourn ed meeting of this Board— carried. The Board then made and perfected their list of Grand Jurors, -after which the Board, on motion, adjourned until the second Mon day of November next, at 10 A. Townsend,Trustees of school district No. 12, in the-towns of Benton and Jerusalem, under and in pur suance of the statute in such case ’provided, for an order directing the levying and collecting the sum of $33 95 on said district for i the payment of a judgment for damages, costs and expanses, against the trustees of said district in favor of Frederick B. Hobart, rccov- ered against them as such trustees. On hearing the said applicants' in favor, and Frederick B. The application o f Lindley Foster coming up for consideration, the following order was made and passed by the Board, a majority of all f h6 members elected to the said Board voting in favor thereof: 5 00 9 71 At an annual meeting of the Board of Supervisors of the county of Yates, held at the American Hotel, in the village of Penn Yan, in said county of Yates on the 16th day of Nov. 1855: Present — Lewis B. Graham, Chairman— Norman Collins, John C. Miller, Ambrose S. Thomas, George W . Spencer, Luther Sisson, Charles Hubbard, Ashbel Hollister, SamucI’V. Miller. Application having been duly made to the said Board of Super visors, pursuant to 'the statute in such case made and provided, by Lindley Foster, one of the Trustees of School District No. 10, in the town of Barrington in said county, for authority to levy and collect by tax on the taxable inhabitants of said district, the sum of $22 66, being the sum expended by him as one of the Trustees in defending an action brought against him and the other two Trus tees by Catharine Bush, and it appearing from the proof before the said Board that this application has been duly made, and that said account has been duly Verified and presented, and notice of this ap plication duly given pursuant to the statute in such case made and provided ; and it also appearing from said proof that Lindley Fos ter has actually paid otit and expended the said sum of $22 56, in and about defending said action, and that said action has been de termined : Now, therefore, the Said Board of Supervisors, pursuant to the statute, in such ease made and provided, hereby order and direct the Trustees of School District No. 10, in the town of Bar- « ring!on aforesaid, to cause to be levied and collected by tax, from the taxable inhabitants of said School District, tile sum o f $22 56, as other taxes are levied and collected in School Districts, and that the same be paid over to Lindley Foster when collected, that being the sum which, in the opinion of this Board, ought justly to be paid to said Foster for the costs and expenses aforesaid. The order drawn upon the Treasury for the last year by the Clerk I df this Board,also by the Clerk o f Yates Co.and the Superintendents of the poor and paid by him being brought before the Board, they were on itiotion ordered burned in the presence of the Board, which order was thereupon executed. The application for the erection of a new town hereinbefore refer- ed to, coming up for consideration. Court aginst John Gibbs, overseer of the Poor of the town of Barrington, in two several actions brought by said Gibbs as Overseer of the Poor o f said town, against Valentine Ritter and Aaron Johnson, respectively, having presented a certified copy o f each of said judgments, and having furnished the Board with due proof that said judgments, hor either of them, nor any part of either of them had been paid, and that the same now amount to the sum of $53 78.
