H er funeral was held Wednesday afternoon at the Herrick funeral home in Margaretville. Rev. Russell Sargent, pastor of the Marga retville United Methodist church, officiated. Burial will be lat^r in the Margaretville cemetery. Mrs. Sonnenberg is sur vived by two sons, Paul Sonnenberg of Bellingham, Mass., and Loren Sonnenberg of Secaucus, N. J., a daugh ter, Mrs. Evelyn Johnsmeyer of Margaretville, two grand children and five great grand children. She was a native of Arkville, bom Jan. 4, 1892 to Sauiford and Harriet Alton Shultis. She was married in 1912 to Ernest Sonnenberg, who died in 1934. Mrs. Sonnenberg was a resident of North Bergen, N. J., from 1916 until 1942, when she returned to Arkville. She had been in the fur trade during that time. Public Notice of Village Ordinance TAlCE NOnCE. that the fol lowing is an Ordinance duly adopted by the Board of Trus tees of the Village of Fleisch- nianns, New York, on December 17, 1973, after a Public Hearing thereon as required by law, and entered in its minutes, to wit: ORDINANCE NO. 68 AN ORDINANCE REGULAT ING JUNK YARDS WITHIN T H E VILLAGE OF FLEISCHMANNS, N E W YORK. SECTION 1. Purpose. The outdoor storage, keeping, dumping or abandonment of junk, including scrap metals and other scrap, waste paper, rags and used or salvaged build ing materials, and/or used for or occupied by the demolition, dismantling, abandonment or sale of 'broken-doWBipor dam aged machinery and/pr house hold appliances, or of aban doned, used, wrecked, broken- down or damaged motor ve hicles which are not intended for further legal use (Hi high way, or p a ^ of or from such motor vehicles on privately owned property within the Vil lage of Fleischmanns is detri mental to the hetdth, safety and general welfare of the com munity. The same also consti tutes an attractive nuisance to children and in some ways im perils their safety. Such storage also endangers the person and property of members of the community, since fuel tanks OHitaining gasoline or gasoline fumes may easily explode. Such storage is unsightly and depre dates property values. The con trol of the outdoor storage of junk on privately owned prop erties within the Village of Fleischmanns is therefore regu lated for the preservation of the health, safety and general welfare of the community. Definitions. A. Junk Yard. Any lot or area of land, with or without buildings, used for or occupied by the storage, keeping, dump ing or abandonment of junk, in cluding scrap metals and other scrap, waste paper, rags and used or salvaged building ma terials: and/or used ior or oc cupied by the demolition, dis mantling, abandonment or sale of broken-down or damaged ma chinery and/or household appli ances, or of abandoned, used, wrecked, broken-down or dam aged motor vehicles which are not intended for further legal use on the highway, or parts of or from such motor vehicles. B. Motor Vehicle. Every ve hicle originally designed and intended to be operated, drawTi or driven or capable of being operated, drawn or driven upon a public highway by any power other than muscular power. For the purpose of this ordinance, the term “motor vehicle” shall include but not will be limited to automobiles, trucks, busses, motorcycles and trailers. C. Abandoned motor ve hicles. One (1) or more motor vehicles which are unregistered, or the major parts equaling in bulk one (1) or more such mo tor vehicles and are not intend ed for further legal use on the highway, and is not stored or deposited in a completely en closed buDding. For the pur pose of this Section, the failure or refusal of the owner, opera tor, lessee or occupant of a lot to produce at the request of the Village Board or its duly au thorized representative, evi dence that any motor vehicle which has remained on said lot for ten (10) or more days, has been registered for some period during the preceding twelve (12) months shall constitute prima facie evidence that said motor vehicle is not intended for further legal use on the highway. D. Junk yard operator. The owner, owners or lessee of a junk yard and/or any person or persons left in charge of such junk yard by the owner, owners or lessee thereof. SEXZmON 3. Outdoor stor age of jimk prohibited. No person shall operate, es tablish, maintain, cause or per mit a junk yard within the Village of Fleischmanns until he has obtained a license so to do from said Village. SECiiON 4. Application for license. A. Application for the li cense referred to in Section 3 hereof shall be made in writing to the Village Clerk of the Vil lage of Fleischmanns, New York, and shall contain a de- scr^tion of the land to be in cluded within the junk yard, the description to be of suffi cient clarity to establish its location. B. Notice of hearing shall be given to the applicant by mail, postage prepaid to the address given in the applica tion, and notice of such hearing shall be published once in the officieil newspaper of the Vil lage or by posting a notice thereof in at least four (4) public places in the Village, specifying the time when and the place where such hearing will be held, and in general terms, describing the matter to be considered at such hearing. Such notice shall be published or posted at least seven (7) days prior to the day specified for such hearing. C. At the time and place set for the hearing, the Village Board shall hear the app>licant and all other persons wishing to be heard and who are en titled to be heard on the appli cation for a license to operate, establish or maintain a . junk yard within the Village of Fleischmanns, N. Y. In con sidering such application, the Village Board shall take into account the suitability of the applicant with reference to his ability to comply with the fenc ing requirements or other rea sonable regulations concerning the proposed junk yard, to any record of convictions for any type of larceny or receiving stolen goods, and to any other matter having a bearing upon the purposes and intent of this ordinance. D. At the time of the hear ing, the Village Board shall take into account, after proof of legal ownership or right to the use of the property de scribed in the license applica tion, the nature and develop ment of the surrounding prop erty, such as the proximity of churches, schools, hospitals, public buildings or other places of public gatherings; and whether or not a junk yard can be operated at the proposed location without adversely af fecting the public health and safety by reason of offensive or unhealthy odors or smoke or of other causes. E. The Village Board may also take into account the clean, wholesome and attractive environment which are consid ered to be of vital importance to the continued general wel fare of the citizens of the Vil lage of Fleischmanns by consid ering whether or not a junk y£ird can be operated at the proposed location without it having an unfavorable effect thereon. In this connection, the Village Board may consider collectively the type of roads that would service the junk yard and from which the jimk yard could be seen, the natural or proposed artificial barriers that would protect the junk yeu^ from view, the proximity of the proposed junk yard to established residential and recreational areas or main ac cess routes thereto, as weU as the availability of other suit able or more suitable sites for the junk yard. F. The Village Board witMn two (2) weeks after the con clusion of the hearing, shall make a finding as to whether or not the application for a license should be grated and shall give prompt notice of said finding to the applicant by mail, postage prepaid, to the address given on the applica tion. If approved, the license shall be issued forthwith and shall remain in effect until the following 31st day of May. Such approval shall be personal to the applicant and the license shall not be assignable. Li censes shall be renewed aimual- ly thereafter upon payment of the annual license fee without hearing, provided all provisions of this ordinance are compiled with, the junk yard does not become a public nuisance under the Common Law and the li censee is not convicted of any type of larceny or the receiving of stolen goods. The determin ation of the Village Boeurd may be reviewed in the manner pro vided by the Civil Practice Law and Rules of the State of New York. G. The annual License fee shall be twenty-five ($25.00) dollars to be paid at the time the application is made and annually thereafter on the 31st day of May in each year in the event of renewal. If the appJi- cation is not granted, the fee shall be returned to the appli cant. In addition to the license fee, the applicant shall pay to the Village of Fleischmanns, the costs and expenses incurred in advertising or posting the notices of hearing, and any and all other expenses clearly at tributable to the processing of the application for a license, and no license shall be issued until such costs and expenses are paid to the Village. The Village Board, in its discretion, may require the applicant to either prepay such expenses or deposit such sum as the Village Board may deem necessary, in anticipation of such e^qienses. Any amount so deposited in ex cess of the actual expenses in curred by the Village shall be refunded to the appdicant. The license fee shall not be pro rated in the event that a license issued covers only a part of a year. All renewals shall be issued for the year commencing June 1st and temninating on the 31st day of the following May. SECmON 5. Fencing. Before use, a new junk yard shall be completely surroundai with a fence at least eight (8) feet in height which substan tially screens the complete junk yard operations, and with a suitable gate which shall be closed and locked except during the working hours of such junk yard or when the applicant or his agents shall be within. Ail material, including motor vehicles and parts thereof, stored or de posited by the applicant Bhall be kept within the enclosure of the junk yard, except as re movals shall be necessary for the transportation of same in the reasonable coiurse of the business. All work upon ma terial, including all wrecking or other wcMrk on such motor vehicles and parts thereof, and aU dismantling or destruction or change in nattire of the ma terial in the yard, shall be ac complished within the enclosure. Where the topography, natural growth of timber or other con siderations accomplish the pur poses of this Ordinance in whole or in part, the fencing require ments set forth above may be reduced by the Village Board, upon granting the license, pro vided, however, that such na tural barrier conforms with the purpoies of this ordinance. SECTION 6. Effect of local ordinances. No provision of this ordinance shall be deemed to be in con travention of or amendatory to any other ordinance, resolution or local law of the Village of Heisciimanns, now in effect or hereinafter enacted, it being the intent to make tne provisions of this ordinance cumulative with any other ordinance, reso lution or local law restricting or limiting the operation or u^e or junk yards in the Village of Fleischmanns. Any applicant for a license hereunder and any owner, operator or lessee of a junk yard in the Village of Fleischmanns shall be required to comply with the provisions of this ordinance as well as the terms of any other ordinance, rule, regulation, resolution or local law of the Village of li'leischmanns presently in ef fect or which may hereafter be adopted or enacted. SEXmON 7. Comply with all applicable rules. Every operator of a junk yard in the Village of Fledsch- manns shall be requii^d to com ply with all aiw>licable rules, regulations, statutes or direc tions of any other municipal or any state or federal agency or authority. Any license here under shaiU ipermit any au thorized officer or representa tive of the Village of Fleisch manns, the State of New York or the Federal Gktvoiunent or other agency with jurisdiction over any aspect of the opera- tiwi of the junk yard, to enter i^ n the premises and make stich reasonable inspection thereof as, in the judgement of such oMcer or representative, may be necessary, at any rea sonable hour of the day duiiiK ordinary working hours. SECTION 8. Established junk yfu-ds. For the purpose of this or- dmance, the location of junk yards already established shall considered approved by the Village Board where located, and the owner thereof deemed suitable for the issuance of a license. Junk yards already es tablished shall be exen^t from the fencing requirements set forth m Section 5 of this or dinance. Witiun sucty (60) days from the passage of this ordinance, however, the owner shall fur nish the Village Board the in formation as to location which is required in an application, together with a license fee. and the V ill^e Board shall issue him a license vjUid until the next May 31st, at which tSme such owner may fq>ply for a renewal, as herein provided. SECTION 9. RestricticHi on location. Notwithstanding any of the foregoing provisions of this or- *nan(», no junk yard hereaf ter estabhsh^, shall be licensed to operate if such yard or any part thereof shall be within tive hundred (500) feet of a church, school, public buUding or place of public assembly. SECrnON 10. Removal pro cedure. .Any junk, as defined by Sec- tion 2 above, may be removed from the premises on which it is located by the Village of Fleischmanns in the manner hereinafter provided. A. Notice.
