Cosby will begin a series of actions Mon day against corporations to compel then: to desist from using soft coal. Mr. Cosby said yesterday th a t on Monday m o rning crim inal proceedings will be brought against the M a n h a ttan E levated Railw a y to compel it to either use anthracite coal or electricity, or a t least stop using soft coal. C ivil, proceedings have already been brought against the company and i t the courts uphold the city the company will be fined $250. But th is is considered too slow a pro cedure, and Mr. Cosby Is of th e opinion th a t crim inal proceedings will be m o re effective. H e said the case would be vigorously pushed in order to get a decision as quickly as pos sible. Inspectors have been em p loyed for the p a s t week, by the Law D e p a rtm e n t, to .go over the entire road, and Mr. Cosby said they rep o rted such a disgraceful condition of th in g s th a t im m e d iate action is necessary. The insp e c to r s reported th a t so f t coal was used on every engine, w ith no a t t e m p t to use an th r a c ite. The company pleaded th a t it had only 1,600 tons of hard coal, w h ic h was being used a t th e ra t e of 300 to n s a day. so th a t in five days It w ill be n e a r ly all used tip. \ ’tVhat w ill you do if they can ’t get hard coal?’’ w as asked Mr. Cosby. \T h e y w ill have to get It,\ he replied.
