Two witnesses were sworn, the complainant and Darius Small, living near Little Falls, when an adjournment was had for dinner. E. A. Brown, of Herkimer, attends to the case for the defence, and A. 0 . Cose is the Government’s counsel. After fur ther evidence taken in the afternoon, the Commissioner allowed Mr. Nellis to go on his OTvn recognizance, until he had a chance to examine the law. Wilson Was not a guest o f the hotel, but a hanger-on. It is claimed by Nellis that Wilson mon opolized the latest papers while legiti mate guests o f the house were anxious to peruse them. H e occupied an extended position at the stove in winter time, and put in h is “ say” whenever a conyersation among guests was going on. The regular boarders in the house complained of Wil son’s conduct, and threatened to leave unless the proprietor taught Wilson to know his place. The matter reached such a point that there was but one alter native left for Mr. Hiram Nellis, the landlord to pursue, and that was to in form Wilson of the complaints. One morning hot long ago, Wilson put in his diurnal anpearance at the hotel, when Mr. Nellis invited him into a side room and told Mm in a kindly way that his presence was objectiouabie\ and that while he (Nellis) was willing to admit him to the barber shop of the house, he was not willing to have him mingle with the guests o f the house so long as he (Wilson) was not a guest. The individual address ed flew into a passion and said that the Girvan House wasu’t much of a hotel after all, and used very profane and inde cent language. Mr. Nellis felt justified in walking Wilson out o f the house. All this did not occur because Wilson is a colored man, hut because his conduct was objectionable, and had his skin been as white as the driven snow he would have been treated the same, as forbear ance had ceased to he a virtue. After his exordium, Mr. S. defined the elements o f character, national and individual, ilius-. trated each by pertinent anecdotes and examples and closed by a forcible applica tion of his argument to those forming character. Every point was finely taken and sustained. The utmost satisfaction was expressed with the manner and mat ter o f the article. The closing lecture of the course was given Wednesday evening, 7 th in s t , by Hon. Geo. W. Smith, of Herkimer, on “ Poets and the new ages.” The rank and office o f the true p oet—his power and its exercise—his exaltation as interpreter of divine law and will—the glorious and exquisite endowments per mitting this—were delineated with a clearness that revealed poetic perception and wide knowledge. Following was dis cussion o f ancient and-~modern writers and their works; Homer, Yirgil, Tasso, ^ I t o n , Tennyson, with quotations and m ih brief references to minor authors, the blessing and utility of poetic endow ments, all made with a clearness and force that held the audience in dose attention throughout the lecture. Salesmen had no difficulty in disposing o f their cheese at 12a, although buyers held firm and would pay no more than that. A number of parties who have been holding over for a week or two past concluded to sell to day, and the transactions ran up to quite respectable proportions for this season o f the year. One lot o f cheese which brought 12ie. was h a lf foeptemhers and half Octo bers, the buyer in reality paying 12ic, for the former and I2c. for the latter. An. other small lot whioh sold at 121o,, was composed of very choice Septembers, which are becoming very scarce. The balance of the sales were Octobers. I t , is stated that factories in this region are making just about double tbe number o f cheepe castomary at.this season of the year. Such a fact as this has a tendency to keep down the price, although It is much more profitable to the producer. It is probable that during the.coming two weeks the delivery will be middling large,, as there is a desire to send cheese on before the canal closes, which will send up tbe price of freights. I quote farm dairy, 457 boxes, ranging from lOo. to 12^c. One lot sold at the lowest and two at,the highest figures. Intermediate prices were lO^c., 11c., lU c .j H f a , 12c. As long ago as we can remember, say, thirty-five years ago, more than half the horses in the country had the heaves, A few years afterward the disease seemed to run out, and from ten to twenty yeai’s ago, a horse that had the heaves was more seldom seen than a sound one in the former period. But since the epizoo tic had such a run amongst the horses, the heaves have greatly increased, and it is not an unusual thing now to find even the best horses with a bad cough, with fast increasing symptoms of heaves. In f' cases where the disease is not seated there is a cure for it. Sanford’s Liquid Heave and Distemper Remedy is proving very effective in curing the disorder. A horse showing any signs of it now, should be attended to that the distemper may b» thoroughly eradicated before the fall weather increases the liability of colds and coughs. A bottle of this remedy may be worth many dollirs to a horse owner, for if given in time, and with sufficient regu larity it will surely efliect a cure.
