Ackerman & Oo. being indebted to Brill & Russell, gave them an Girder for $3(K) upon vhe defendant, who was omug Ackerman & Co. The defendant refused to accept it, and afterwards USSd a portion o f the money then in his hands to pay workmen, and paid the balance to Ackerman & Go. The action was b rought to recover th e $300.
