NOTICE of COMPLETE APPLICATION NATURAL RESOURCES SPECIAL PERMIT Notice Date: De- cember 27, 2012 Please take notice that Carol & Henry Herman have made application for a Natural Resources Special Permit pursuant to Section 255-4-20 of the East Hampton Town Code. If the com- mittee deems an applica- tion complete it shall noti- fy the Town Clerk who shall then issue the license. If the committee denies an application, the applicant shall have the right to appeal the denial to the Town Board; The Town Board shall by reso- lution, adopt a schedule of fees associated with an application for a license or renewal license; Appli- cants shall be required to maintain a physical busi- ness office within the Town of East Hampton. The applicant shall obtain all required use permits, pursuant to chapter 255, and shall obtain a proper certificate of occupancy for the premises prior to the issuance of a license pursuant to chapter 226. The proper certificate of occupancy shall be pre- sented to the Town Clerk as part of the application materials; All taxi cabs licensed shall have TLC, T- or taxi cab license plates issued by the New York State Department of Motor vehicles (NYS DMV); Applicants for a Taxi cab Driverís License shall disclose if they have ever been convicted of a felony or if they have any convictions, regardless of level, i.e. misdemeanor or felony, under Articles 120 (Assault and related offenses), 125 (Homi- cide), 130 (Sex Offenses), 135 ìKidnapping, coer- cion, or other offenses), 155 (Larceny), or 160 (Robbery) of the New York State Penal Law. The applicant will also need to disclose if they are a level two or three sex offender, pursuant to Chapter 168 of the New York State Corrections Law and shall disclose if the applicant has ever had an ìindicatedî; A license issued pursuant to Chapter 226, shall be valid for one calendar year, January 1st through December 31st. The fee for a license shall not be prorated; Not allow the taxi cab to be used in business if it is more than 10 years old or if it has in excess of 250,000 miles on the odometer, this provi- sion would go into effect starting January 1, 2014; Taxi cab drivers shall not be permitted to sit with its engine idling for more than five consecutive minutes.
