After dictating his confusion last night, he remained pesceful until morning, aleoping a little at intervals, Heo refused to the last to receive a clergyman, saying they could not send his soul to heaven or hell. The trap was arranged in the corner of the jail. Marlow was brought ont at five minutespast twelve. He sat down on the platform while Sheriff Harrington read his death warrant. He then took his place on the trap without one tre} mor of the muscles, and in a low but dis- tinet voice said he was not directly guilty of the crime for which he was to suffer. He farther statéd that he had mades full statement of all his knowledge of the murder in his written confession. He asked pardon of the sheriff and his offi- cers fot the trouble he had caused them. At serenteen minutes past twelre sboriff Harrington sprung the trap. The ' fall was seven feet, dislocating his neck and causing death without a s le. It was the case of the administrators of G. A. Whitling, deceased vs. The Railway Pare sengers Assurance Company, of Hartford, Conn. Thoervidence was ig effect that in 1889, Mr, Whitling, of Cochranton, Crawford conuty, purchased a ticket of the agent of the above named company, at Pittsburgh, good for twenty-four hours. It was dated 7 a.m., Maroh '12, 1869. Oa biv way home, waoilo getting on the cars at Meadville, boldiog on the gusrd of the last bar, bo was thrown us- der the wheels, and his legs arushed. This was on Friday, and at threa p m, he died on the tabbath following. The in surance was $5,000, in case of desth, while travelling by public or private con- veyance, during the life of the policy. The defence was in effect that the decseas- ed was not travelling by either publico or private conveyance at the time of the se- cideut. That is, that guano; on or off & public coovrsyance is not to be considered as the act of travelling by them. The court, however, could not draw so fine a line between the act of travalling as this, and ruled that the company could not eacape liability in such away, The evi- dence, about which there had been no question, showed that deceased bad re- coaived injuries which bad cost him his life, while hoe was endearotring to prose cute his journey, and the jury, without leaving the box, returned a verdict in fa- vor of the adcorinistrators of the deceased, for $5,975, tho amount of the interest from date at which {t was due, CoURT PROOZZDINGS. aaa Fregont--Hon.
