This money was provided by the Iwrae and sale of 118,000,000 of the B. R. T. receiver's 6 per cent two year certifi- cates. The proceeds of $5,000,000 oi these certificates havevbeen retained by fth B. It T. receiver mainly for power development, the proceeds of the re- maining $13,000,000 being advanced for fii by the rapid transit company's re- ceiver under the city contracts. Against this advance the rapid transit companies' \'receiver 'has issued 113,000.000 of certificates secured by a Hen Snpon all the properties of those comp- anies prior to the subway bonds and Jjunlor to the underlying bonds, these being In turn pledged to securo V the B. It. T. receiver's certificates . Company proper are now, in general, confined to completing the add! \tloral power generating facilities and furnishing power and doing repair and maintenance work for both the rapid transit and surface lines. R. T. notes and subway bonds. As already stated, without an Increased tare no substantial contribution t6ward your Interest can be expected from the surface lines or from the properties of ;the B. R. T. Company proper. Efforts 3are being made to secure higher fares aee au lines. \There have now been deposited with .tht committee about 330,000,000 of the jthree year notes, which, together with tho $16,644,700 of that Issue held by the War finance Corporation, which has been cooperating with the committee, constitute over 80 per cent, of the entire amount outstanding. An opinion handed down In the United States Circuit Court of Appeals here to-d- holds that the Equitable Trust Company of 'New York isjsntltled to collect $51,866,297.98 from the Wabash Railroad Company. The opinion affirms the judgment rendered against the railroad company by Judge Elmer B. Adams. When the Wabash went Into receiver- ship In 1914 the trust company, as trus- tee, held a mortgage against it The mortgage, long overdue, was foreclosed against the property which It covered, That property was sold, but the proceeds lacked $51,366,297.98 of covering the amount of the mortgage.
