Early In the morning Of Saturday, December 12, the Rt. Rev. Bishop Cusack will conseecrate the church building. But the real ceremonial will come the next day , when, at 11 clock, there Will be a solemn pon tifical high mass celebrated by BIs- slstaot priest af St Mary's. Rt, Reyi Mgr Mooney, who 1 was a classmate of the Rev Father Corley, rector of St. Mary ’ s, will deliver the nermon, and Archbishop Farley will preside and address the congregation. Mr. William Bunselmeyer, a mer chant of Elmsford, has got up a pe tition to the Hoard of Health of the town of Greenuurgh, with reference to the unloading of carloads of ma nure and fertilizing refuse on the Elmsford siding of tho Putnam Di vision, N. Y. central. The petition has been signed by the village doc tor and other leading citizens, and It Is to be hoped that the Board will take action to abate' the nuisance. The petitioners claim thaly the un- healthful and offensive odors arising from this fertilizing refuse contam inates tho atmosphere, makes' the homes In the neighborhood almost unbearable and fs a menace to the health of the inhabitants of the neighborhood. Marlin Kern, livery stable em ployee at Tarrytown. Witness saw Brady and defendant together at Glenville on roadway on August 20 at 7 p. m. In an argument, both puH- ing on a lantern for the possession of the lantern. Talking loud^ in angry tones. Under cross-examination Kern said ho heard the angry talk but could not tell just what was said. Tho two men had three or four lanterns^ clutched between t^iem and they walked together down the road talk ing of lights at the culvert. Later Brady walked back toward Tarry town and witness left him at the Steam roller. Later witness saw Guono at Johnson ’ s saloon, but Guono had pulled the lanterns from Brady ’ s hand before the men sep arated. Under question from Juror 1, Thomas Paskett, witness, said he had seen no fight or any blows struck. Guono told Brady to go home and see Murray Monday. Mrs. Annie Tompkins, of Glen ville. said at or about 7 p. m. on Saturday she saw three men; one was Kern, the other the defendant, anOho third an Irishman, in heated conversation, and she heard the Irishman say, •\Italian what ’ s tho matter with you ? Edward Tompkins, of Glenville, corroborated his wife, who had pre ceded him on the stand, adding that the men ’ s talk was so loud that ho could near them before they came in sight. When near the roller, Brady advanced on the Italian who exclaimed. \Me no afraid you. ” The cross-examining failed to shake his story . Robert Merritt, of Glenville, saw ree men named on Saturday night near his residence abpul 7> p. m. in loud conversation. Frank Abbath, of Elmsford, saw Guono. about 7:30 or 8 p. m. on Saturday.
